The Town of Springfield Board and Planning Committee have both unanimously <br /> recommended approval of the rezoning and conditional use permit. The Town <br /> recommends the following restrictions be applied to the outdoor activities: <br /> 1. Closing hours of operation: Sunday through Thursday--11:00 p.m.,Friday <br /> and Saturday--12:00 a.m. <br /> 2. Parking space lease agreement on file. <br /> 3. Security agreement in place. <br /> 4. Party patio will include a music stage, dance floor, drink and dining tent, and <br /> bathroom facilities all enclosed in a permanent fence. <br /> 5. Necessary sanitary facilities provided(portable units allowed). <br /> III. SUMMARY <br /> A. There are neighborhood issues associated with introducing the proposed use to a <br /> predominantly residential area. Steps have been taken by the applicant and are <br /> suggested by the Town and staff to minimize those impacts. The proposed number <br /> of parking stalls are sufficient to meet the County's parking requirements for the <br /> existing tavern and the party patio. However, expansion to the party patio would <br /> be possible only after receiving a parking variance. Staff believe that the proposed <br /> use generally satisfies the standards for granting CUPs. <br /> B. Before making a decision, staff advises that the ZNR Committee first make <br /> findings of fact based on evidence presented and issue a determination as to <br /> whether the prescribed standards for granting a CUP are met(S. 10.255(2Xa)). <br /> C. If the ZNR Committee wishes to approve this request, it may want to include the <br /> following conditions of approval: <br /> 1. The subject property shall be developed consistent with the site plan dated <br /> 7/30/97. <br /> 2. The party patio shall be completely enclosed by a permanent fence. The fence <br /> along the southerly edge of the party patio shall be six feet in height and <br /> opaque to provide noise and visual screening. <br /> 3. The operator shall provide and maintain, at a minimum, portable sanitary <br /> toilets within the party patio. <br /> 4. Any lighting of the proposed stage shall be directed towards the stage area. <br /> 5. The proposed expansion of the party patio may be developed only after the <br /> applicant applies for and receives a parking variance from the Board of <br /> Adjustment. This condition does not imply that the Board of Adjustment <br /> waives its discretion to approve or deny the variance. <br /> 6. No other neighboring properties may be used for parking for the use unless the <br /> Board of Adjustment approves a variance authorizing such parking. If <br /> neighboring properties are approved for parking, the operator shall enter and <br /> maintain lease agreements, which shall be filed with the Town and County. <br /> 7. The party patio shall close no later than 11 p.m. on Sunday through Thursday <br /> nights and 12 a.m. on Saturday and Sunday nights. <br /> 8. The operator shall enter and maintain security agreements for events at the <br /> party patio. <br />
