4) The Dohmeiers returned to the property in October of 1996. A building permit for a <br /> single family dwelling (2,666 square feet of living area plus 726 square feet for an <br /> attached garage) was issued on October 21, 1996. A second building permit for a 30' x <br /> 36' pole barn was issued on April 2, 1997. Two horses were placed on the property in <br /> October of 1996. The property was zoned A-1 at the time. <br /> 5) In the spring of 1997, the Dohmeiers were informed of the property's non-compliance <br /> status regarding the placement of horses on the property. Thus, the petition to rezone the <br /> property to RH-1 was initiated. <br /> -Several Board members expressed concern regarding spot zoning and the potential precedent <br /> approval of the zoning petition may establish in the Town of Middleton. A substantial number of <br /> other properties less than 5 acres exist in the Town of Middleton. Many of these properties are <br /> currently zoned A-1. <br /> Finally, it is relevant to point out that Section 10-2-42(e)(3) of the Town of Middleton <br /> Ordinances which was in effect at the time of the CSM and remains in effect today required that <br /> zoning changes be identified at the time of filing of the CSM. The Dohmeiers indicated during <br /> the meeting on July 21, 1997, that it was their intent at the time the CSM was filed in 1993 to <br /> have horses on the property. However, no indication of any potential rezoning was provided at <br /> that time, contrary to Town Ordinances. <br /> Clearly, the Dohmeier rezoning petition was a difficult decision for the Board of Supervisors <br /> of the Town of Middleton. The Town Board adopted a position which reflects a consistent <br /> opposition to spot zoning and the use of zoning regulations to accomplish property use decisions <br /> on substandard parcels. <br /> We appreciate the opportunity to communicate the Town's decision and rationale regarding <br /> this matter to your office.
