DEED RESTRICTION <br /> PAGE 4 <br /> to the Northeasterly edge of the Wisconsin River; thence along the water's edge approximately S <br /> 20° 38' East, 1105.7 feet to the Southeasterly line of Lot#2, Block 3, of the vacated Plat of <br /> Clifton, Town of Roxbury. Thence N 70° 30' East along said Southeasterly line 368.8 feet more <br /> or less to the centerline of the vacated Front Street; thence N 19° 30' West along said centerline, <br /> 330.0 feet to the extension of the Southeasterly line of Lot#4 and Block 7, of said vacated plat; <br /> thence N 70° 30' East along said extension and said Southeasterly line, 305.25 feet to the <br /> Southwesterly right-of-way line of State Highway 78, thence N 19° 30' West along said <br /> Southwesterly right-of-way line, 346.5 feet to the point of beginning. <br /> II. WHEREAS said owner desires to place certain restrictions thereon, <br /> to bind the owner and those who may acquire title hereafter. <br /> III. NOW, THEREFORE, in consideration of the mutual benefits passing to <br /> and from the owner and those who may hereafter purchase said land <br /> and the parties named as beneficiaries of these restrictions, the <br /> following restrictions are hereby imposed: <br /> 1 . Approval of a Certified Survey Map (s) or plat that creates no <br /> more than a total of ten, single family residential lots <br /> with no more than eight lots located east of Highway 188, as <br /> defined in paragraph 1 above. The Certified Survey Map (s) or <br /> plat will also include the river bottom area and the <br /> approximately 6 acre Round Top Bluff Area as unbuildable outlots. <br /> 2 . The execution and recording of easements between Mr. Reible, <br /> WDNR, and the Council that restrict uses of the land to those <br /> generally described in a,b, c, d below and consistent with the <br /> protection of eagle habitat. <br /> a. A limit on the overall density of development, limiting the <br /> entire 40 acre tract (in both Dane and Columbia Counties) to no <br /> more than ten, single family residential dwelling lots and no <br /> more than eight single family residential lots being located east <br /> of highway 188 . (Of the eight lots east of highway 188, five <br /> would be in Dane County and three would be in Columbia County. ) <br /> Once created, each of the ten lots would be restricted from any <br /> further subdivision regardless of changes in zoning law that may <br /> occur in the future. <br /> b. Limit exterior construction activity on the lots to the period <br /> of March 1 to October 30, to minimize disruption of the site <br />
