Identify any environmentally sensitive areas within the <br /> proposed residential lots and limit or prohibit construction <br /> within those identified areas. <br /> d. Grant the Ferry Bluff Eagle Council the affirmative right to <br /> manage vegetation in portions of the residential lots that <br /> provide an immediate buffer area to the rest of the Round Top <br /> Bluff outlot. These affirmative rights would include the right to <br /> manage the vegetation in the buffer area. <br /> 3. The execution of option agreement beyween Mr. Reible and WDNR <br /> to purchase the river bottom unbuildable outlot as designated on <br /> the Certified Survey Map (s) or plat. (lot 1 on the concept map <br /> dated July 31, 1997) . <br /> 4 . The execution of option agreement between Mr. Reible and WDNR <br /> to purchase an easement affecting approximately 6 acres that <br /> include Round Top Bluff for its value as determined by an <br /> appraisal prepared for the WDNR. <br /> 5. The execution of an option agreement between Mr. Reible and <br /> the Council to purchase fee title to approximately 6 acres that <br /> include Round Top Bluff as an unbuildable outlot designated on <br /> the Certified Survey Map (s) or plat for its residual value as <br /> determined by an appraisal prepared for WDNR after the <br /> restrictions of WDNR have been placed on the title. (lot 9 on the <br /> concept map dated July 31, 1997) . <br /> 6.The concept map dated July 31, 1997 with appropriate zoning <br /> classifications shall apply. <br /> 7 .To require the removal of all buildings on the proposed lots <br /> with the exception of the building (s) located on lot #2 . <br /> 8 . That there shall be no development in the floodplain. <br /> These restrictions shall constitute covenants running with the land <br /> and shall be binding upon all parties now owning any part of said <br /> land, their successors, heirs and assigns, and all parties holding <br /> under them unless, pursuant to paragraphs 5 or 6 of this <br /> instrument, said restrictions are amended or terminated. <br /> IV. The restrictions provided for herein shall be enforceable at law or <br /> equity against any party who has or acquires an interest in the <br /> land subject to the restriction by the following parties who are <br /> named as grantees, promisees and beneficiaries with enforcement <br /> rights: <br />
