Mr. Van Deurzen and other members (cont.) 2 <br /> The WDNR would purchase from Mr. Reible all or a portion of the property located between <br /> Wisconsin Highway 188 and the Wisconsin River, which would be designated as an unbuildable <br /> outlot on the Certified Survey Map(s) or plat. In addition, WDNR would purchase the <br /> development rights of the Round Top Bluff parcel that would be designated as an outlot on the <br /> Certified Survey Map(s) or plat. <br /> After the WDNR easement on development rights is in place, the Council would purchase title to <br /> the Round Top Bluff outlot. The outlot would therefore be subject to restrictions of the WDNR <br /> easement. The Council would also obtain access to Kehl Road through easement on one of the <br /> residential lots if the Round Top Bluff outlot does not have direct access to Kehl Road. At <br /> closing, the Council would also obtain easements from Mr. Reible that would cover the entire <br /> Certified Survey Map(s) or plat. Restrictions within this easement would include: <br /> a. A limit on the overall density of development, limiting the entire 40-acre tract (in both <br /> Dane and Columbia Counties) to no more that ten, single-family residential dwelling <br /> lots and no more than eight single-family residential lots being located east of Highway <br /> 188. (Of the eight lots east of Highway 188, five would in Dane County and three <br /> would be in Columbia County.) Once created, each of the ten lots would be restricted <br /> from any further subdivision regardless of changes in zoning law that may occur in the <br /> future. <br /> b. Limit exterior construction activity on the lots to the period of March 1 to October 30, <br /> to minimize disruption of the site during winter months when eagles are in the area. <br /> c. Identify any environmentally sensitive areas within the proposed residential lots and <br /> limit or prohibit construction within those identified areas. <br /> d. Grant the Council the affirmative right to manage vegetation in portions of the <br /> residential lots that provide an immediate buffer area to the rest of the Round Top <br /> Bluff outlot. These affirmative rights would include the right to manage the vegetation <br /> in the buffer area. <br /> The easement would also impose restrictions on the use of the river bottom outlot acquired by the <br /> WDNR necessary to protect eagle habitat. The easement would include restrictions intended to <br /> minimize disturbance of vegetation and activities that would interfere with use of the areas by <br /> eagles, particularly in winter. <br /> The Council supports the requested rezoning of the property only if it is subject to the following <br /> conditions upon approval: <br /> 1. Approval of a Certified Survey Map(s) or plat that creates no more than a total of ten, <br /> single-family residential lots with no more than eight lots located east of Highway 188, <br /> as defined in paragraph(a) above.
