DECLARATION OF DEVELOPMENT PLAN <br /> AND PROTECTIVE COVENANTS <br /> DECLARATION made as of �C1 , /G98 , <br /> by LAVERNE J REIBLE and BON TA S REIBLE, husband and wife <br /> (Declarants ) as to Lots Two (2) thru Ten (10) . <br /> WHEREAS, Declarants are the record owners of certain <br /> parcels of real estate in the Counties of Dane and Columbia <br /> and State of Wisconsin, legally described in Exhibit A <br /> attached hereto and made a part hereof; and <br /> WHEREAS, Declarants have caused to be recorded a plat <br /> of a subdivision (Plat ) of said real estate, to be known as <br /> Eagle Terrace Subdivision (Subdivision ) ; and <br /> WHEREAS, Declarants are desirous of establishing for their <br /> own benefit and for the mutual benefit of all future owners <br /> of lots in the Subdivision certain mutually beneficial <br /> covenants, conditions, restrictions, easements, reservations, <br /> and agreements (sometimes, collectively, "Covenants ") with <br /> respect to the developement and use of the Subdivision and <br /> lots thereof; and <br /> WHEREAS, Declarants intend that such covenants, <br /> conditions, restrictions, easements, reservations, and <br /> agreements shall constitute a general plan of developement <br /> and protective covenants and restrictions imposed on all lots <br /> in the Subdivision and shall be binding upon Declarants and <br /> all persons acquiring title to lots in the Subdivision from <br /> or through Declarants or their respective heirs, legal <br /> representatives, assigns or devisees. <br /> NOW, THEREFORE, Declarants, as the record owners of <br /> all of the lots of the Subdivision and for the purposes above <br /> set forth, hereby declare as follows : <br /> -1- <br />
