DECLARATION OF RESTRICTIONS AND COVENANTS <br /> 1 . GENERAL PURPOSE: <br /> The purpose of these covenants is to insure the best use and <br /> the most appropriate development and improvement of each building <br /> site hereof; to protect each owner of a lot against improper uses <br /> by any other owner; to preserve, so far as practicable, thereon of <br /> poorly designed or poorly proportioned structures, or structures <br /> built of improper or unsuitable material; to obtain harmonious use <br /> of material and color schemes, to insure the highest and best <br /> residential development of said property; to encourage and secure <br /> the erection thereon of attractive, adequate sized homes, which <br /> conform and harmonize in external design; to secure and maintain <br /> proper setbanks from streets, and adequate free spaces between <br /> structures, and in general to provide for high-quality improvements <br /> which will protect the investments made by purchasers of such lots. <br /> 2. LAND USE AND DWELLING TYPE: <br /> No lot shall be used except for single family residential <br /> purposes. No building shall be erected, altered or permitted to <br /> remain on any lot other than one single family dwelling with an <br /> attached private garage for a minimum of two and maximum of four <br /> vehicles, and other outbuildings incidental to residential. <br /> Declarants shall have the authority to determine the location <br /> of the residence structure and all other structures on the lot, as <br /> well as the maximum finish grade line and the minimum finish grade <br /> line of each lot, taking into consideration the street line (s), the <br /> location of structures on adjacent lots, the location of the lot <br /> within the Subdivision, the location of trees and other landscaping, <br /> the topography of the lot, the location of septic systems and <br /> utilities, and all other factors they consider relevant; provided, <br /> however, their required location of the resident structure must not <br /> prohibit the owner from building upon, or utilizing the balance <br /> of, the lot in a reasonable manner. <br /> 3. SUBDIVISION: <br /> No lot described shall be further subdivided. This shall not <br /> prevent two or more lots being combined for the construction of <br /> one single dwelling. <br /> 4. DWELLING TYPES AND SIZES: <br /> The following minimum floor area shall apply to all single <br /> family residential dwellings erected on any lot: <br /> (a) No single story dwelling shall have less than 1500 <br /> square feet. <br /> (b) No two-story dwelling shall have less than 1800 square <br /> feet. <br /> (c) No raised ranch, bi-level, or tri-level dwelling shall <br /> have less than 1400 square feet on the main level . <br /> (d) For purposes of determining floor area, stair openings <br /> shallbe included, but open or screened porches, attached garages <br /> -2- <br />
