BSC&F Boardman, Suhr, Curry & Field <br /> Town requested covenant use restrictions: <br /> The use of property shall be limited to: <br /> (1) Mineral extraction, limited to continuation of those mineral <br /> extraction operations that met the county zoning definition of a <br /> non-conforming mineral extraction site as of August 5, 1997, <br /> subject to all requirements applicable to a nonconforming <br /> mineral extraction use and site; and <br /> (2) The following uses allowable under C-2 zoning, subject to the <br /> limitations stated in this section and subsequent sections of these <br /> Restrictions: <br /> (a) County Ordinance §10.14(1)(f) Repairs, storage and <br /> service of contractor's machinery and equipment; and <br /> (b) County Ordinance §10.14(1)(h) Bulk fuel storage. <br /> (3) Notwithstanding the uses enumerated in sections (1) and (2) <br /> above, the following additional restrictions apply: <br /> (a) Only the machinery and equipment of the owner of the <br /> property shall be repaired, stored and serviced. The <br /> phrase "the owner of the property" shall not include <br /> persons or entities occupying the property by virtue of a <br /> lease, license, or similar arrangement; <br /> (b) Storage of bulk fuel only for the use of the owner of the <br /> property; same definition of owner as enumerated in (a) <br /> above; <br /> (c) The bulk fuel storage use does not include sales and <br /> storage of lumber and building materials. <br /> (d) Not more than 15 pieces of machinery and equipment, <br /> including vehicles, shall be on the premises at any one <br /> time, whether they are within structures or not within <br /> structures, and whether they are used for the mineral <br />
