Lehmann, Counsel, Town of Albion <br /> DATE: August 5, 1997 <br /> RE: Rezoning Petition 6967/Halverson/Town of Albion <br /> Your committee has been informed through the report of the Town Clerk on this <br /> rezoning that the position of the Town Plan Commission and a majority of the Town <br /> Board was to support the rezoning, subject to imposition of binding use restrictions <br /> through the county's conditional rezoning procedures of Dane County Ordinance Section <br /> 10.255(3)(a). <br /> The following are the use restrictions that the town requests be imposed by the <br /> county. Pursuant to county ordinance Section 10.255(3)(b), the use restrictions should <br /> state that enforcement rights over the use restrictions shall be granted to the county, the <br /> town, and the owners of property within 300 feet of the site. The language should also <br /> state that the covenants shall run with the land unless they would be amended or repealed <br /> through legislative action by the County Board preceded by a public hearing. <br />
