If the committee is somehow able to construe the LAND USE PLAN as allowing this <br /> proposal, any realistic enforcement provisions for any deed restrictions are absolutely <br /> essential. <br /> 3) THE PROPOSAL SEEKS TO EXPAND A NON-CONFORMING USE IN <br /> VIOLATION OF DANE COUNTY ZONING CODE SECTION 10.21 <br /> Section 10.21 of the Dane County Zoning Code states no building or premises used as a <br /> nonconforming use shall be added to or structurally altered so as to increase the facilities <br /> for such nonconforming use. <br /> By definition, the existing quarry is a nonconforming use which legally operates at its <br /> location. However, although the quarry legally exists, it cannot be legally expanded. Mr. <br /> Halverson's proposal either relates to the quarry, in which case he is expanding its <br /> operations or it represents a new isolated commercial development. Either way,the <br /> proposal violates the standards contained in the Code and Land use Plan. <br /> SUMMARY <br /> On behalf of himself and his neighbors, Kent Schroeder asks you to reject this petition <br /> which on its face is inconsistent with the LAND USE PLAN. <br /> When the residents moved into the area, they relied on the Town and the County to <br /> enforce the provisions and stated goals of the LAND USE PLAN. <br /> Mr. Halverson's proposal seeks to undermine the character of our neighborhood by <br /> bringing commercial development into the mix. This brings additional traffic into the <br /> area raising additional questions of our safety and welfare. It also opens the door to <br /> additional, more intrusive, commercial development further destroying the rural character <br /> promised by the Town. <br /> The proposal is contrary to the Town's Land Use Plan and the Dane County Zoning <br /> Code, and I urge you to deny Mr. Halverson's petition in the same manner the petition <br /> was denied on January 23, 1997. <br /> Thank you for your consideration in this matter. <br /> Since ='y <br /> 14 4 1 • <br /> ' .
