Mr. Halverson and I both appeared and testified at <br /> the public hearing for this matter on July 22, 1997 . Mr. Halverson <br /> and I will also be present at the Committee' s work meeting tonight <br /> and will be available to answer any questions from the Committee . <br /> In response to Attorney Boushea' s first claim that the <br /> application has already been considered and rejected, I refer the <br /> Committee to the testimony of Mr. Halverson and myself on July 22, <br /> 1997 on that point . Application 6967 is for the rezoning of a <br /> completely separate and distinct portion of the property owned by <br /> Mr. Halverson in the Town of Albion. The subject of the former <br /> application and the current application are separated by an <br /> existing berm and are completely dissimilar in their relationship <br /> to the view from Raymond Road, their relationship to the previously <br /> rezoned RH-1 portion of the property and the proximity to <br /> neighboring properties . <br /> In addition, before he submitted the current application, Mr. <br /> Halverson consulted with Dane County Zoning and was told that a new <br /> application would be permitted if a different portion of his <br /> property was the subject of the rezone . The preliminary Certified <br /> Survey Map submitted with the current application shows the <br /> differences between the prior application and the current <br /> application. <br /> As an initial matter, this is a completely different request <br /> dealing with a different piece of property from the prior <br /> application and is therefore not a resubmittal . Furthermore, even <br /> if the current application is viewed as a resubmittal, the new <br /> location of the proposed rezone is a substantial change in <br />
