• <br /> 2. PROHIBITED USES. Any activity on or use of the Property inconsistent <br /> with the purpose of this Grant is prohibited. The Property shall be used for agricultural, <br /> forestry, noncommercial recreation, and open space purposes only. No residential, <br /> commercial, industrial, or mining activities shall be permitted, and no building, structure <br /> or appurtenant facility or improvement shall be constructed, created, installed, erected or <br /> moved onto the Property, except as specifically permitted under this Grant. Without <br /> limiting the generality of the foregoing, the following activities and uses are expressly <br /> prohibited: <br /> (a) The subdivision of the Property into smaller parcels, whether through <br /> legal or de facto subdivision of the Property, including division of the Property <br /> through the creation of condominiums or other means, except: <br /> (1) The "Park Tract" may be divided and separately conveyed to <br /> the Town; <br /> (2) Two residential lots encompassing all or part of the "Woods <br /> Tract" may be divided and separately conveyed; <br /> (3) A portion of the "Farm Tract" consisting of not less than 35 <br /> acres in area, and not including any portion of the Farmstead <br /> Area, may be divided and separately conveyed; <br /> (4) Adjoining landowners may make lot line adjustments not <br /> constituting land divisions with the consent of both Grantees. <br /> (b) Use of the Property for commercial or industrial purposes, including <br /> use by easement or other right of access or passage across or upon the Property in <br /> conjunction with commercial activity, except as provided below: <br /> (1) The Property may be used for agricultural and forestry <br /> purposes, provided that such activities are conducted pursuant <br /> to a soil and water conservation plan approved by the United <br /> States Department of Agriculture or the Dane County <br /> Conservationist or by another qualified person approved by the <br /> Town, and including the sale of agricultural and forest <br /> products grown on the Property. <br /> (2) The Grantor or occupants of the permitted residence(s) may <br /> carry on home occupations within such residence(s), provided <br /> that: (i) such uses are incidental to the residential use of the <br /> H:\W I P\1 126\155\EAS EMEN2.MPD <br /> 0415971138 - 4 <br />
