This access easement is intended to provide said owners with a <br /> reasonable means of access from County Hwy "KP" , a public highway. <br /> This access easement shall pass with each said Lots 1, 2, 3 , A, B and <br /> C as an appurtenance thereto and, except as otherwise provided herein, <br /> may not be severed, transferred, assigned or otherwise alienated separ- <br /> ate or apart from each said parcel. <br /> Easement to Government Grantor does hereby create, establish, <br /> dedicate and grant a permanent and perpetual easement to the United States, <br /> State of Wisconsin, Dane County and Town of Black Earth and to their re- <br /> spective agencies , departments or branches and the employees, agents and <br /> representatives thereof, over, across , through and upon the described <br /> easement real estate for the purpose of performing such duties and activ- <br /> ities related to law enforcement , fire protection and medical and emer- <br /> gency situations on or for any portion of said Lots 1, 2 , 3 , A, B and C <br /> or any person thereon. In the event , gates control, limit or restrict <br /> vehicular or pedestrian access to and from any portion of the described <br /> easement real estate, the gates shall be constructed as breakaway <br /> type gates and all governmental authorities are authorized to break <br /> through said gates , if necessary, in an emergency situation, and shall not <br /> be liable for any damage caused by said emergency entry. <br /> Easement to Utilities Grantor does hereby create, establish, dedi- <br /> cate and grant a permanent and perpetual easement to any public utility, <br /> municipal corporation or other person or entity which constructs or <br /> operates a public utility, as hereinafter described, over, across , under <br /> and through all portions of the described easement real estate which are <br /> reasonably necessary for the purpose of installing, erecting, replacing, <br /> -2- <br />
