relocating, maintaining and operating public utility systems which include, but are not limited to, master television and/or cable systems , security and similar systems, sanitary sewer systems and all other utilities neces- sary or convenient for the use of said Lots 1, 2 , 3 , A, B and C, including without limitation, publicly or privately owned and operated electrical, gas, telephone, water and sanitary sewer services , storm drains and sewers, drainage systems and facilities , lines , pipes , conduits, equipment, ma- chinery and other apparatus and appurtenances necessary or otherwise rea- sonably required in order to provide any utility service to any portion of Lots 1, 2 , 3 , A, B and C. Maintenance The driveway shall be reasonably maintained by the owners of said Lots 1, 2 , 3 , A, B and C. Reasonable maintenance may in- clude, without necessarily being limited thereto, grading, gravel, ditch- ing, culverts and snow and ice removal. The decision of a majority of owners responsible for payment of the need to perform any item of main- tenance shall be final and binding on all lot owners. The maintenance costs shall be shared equally by the said lot owners , provided that in determining the maintenance cost to be paid by each lot owner, the actual portion of the driveway used by the lot owner for access to the owner' s lot shall be considered along with the particular maintenance item. A lot owner shall not be required to contribute to the cost of a mainten- ance item over any portion of the driveway not used by that owner as a means of access . If a lot owner shall, through their use or use by their invitees or by contractors or subcontractors making improvements to an owner's lot , cause unreasonable wear thereto, such owner shall be solely responsible for the repair of such unreasonable wear. It is the intent of this Easement & Maintenance Agreement that the driveway be maintained -3-
