relocating, maintaining and operating public utility systems which include, <br /> but are not limited to, master television and/or cable systems , security <br /> and similar systems, sanitary sewer systems and all other utilities neces- <br /> sary or convenient for the use of said Lots 1, 2 , 3 , A, B and C, including <br /> without limitation, publicly or privately owned and operated electrical, <br /> gas, telephone, water and sanitary sewer services , storm drains and sewers, <br /> drainage systems and facilities , lines , pipes , conduits, equipment, ma- <br /> chinery and other apparatus and appurtenances necessary or otherwise rea- <br /> sonably required in order to provide any utility service to any portion <br /> of Lots 1, 2 , 3 , A, B and C. <br /> Maintenance The driveway shall be reasonably maintained by the <br /> owners of said Lots 1, 2 , 3 , A, B and C. Reasonable maintenance may in- <br /> clude, without necessarily being limited thereto, grading, gravel, ditch- <br /> ing, culverts and snow and ice removal. The decision of a majority of <br /> owners responsible for payment of the need to perform any item of main- <br /> tenance shall be final and binding on all lot owners. The maintenance <br /> costs shall be shared equally by the said lot owners , provided that in <br /> determining the maintenance cost to be paid by each lot owner, the actual <br /> portion of the driveway used by the lot owner for access to the owner' s <br /> lot shall be considered along with the particular maintenance item. A <br /> lot owner shall not be required to contribute to the cost of a mainten- <br /> ance item over any portion of the driveway not used by that owner as a <br /> means of access . If a lot owner shall, through their use or use by their <br /> invitees or by contractors or subcontractors making improvements to an <br /> owner's lot , cause unreasonable wear thereto, such owner shall be solely <br /> responsible for the repair of such unreasonable wear. It is the intent <br /> of this Easement & Maintenance Agreement that the driveway be maintained <br /> -3- <br />
