in a condition that permits regular use by motor vehicles for ingress and <br /> egress and which is reasonably safe and which the motor vehicle should be <br /> able to negotiate at a reasonable speed without damage. The condition of <br /> the driveway upon completion of its initial construction shall be a stan- <br /> dard by which the need for maintenance in the future shall be measured. <br /> Improved Width The improved portion of the described easement real <br /> estate, the driveway, shall be constructed and maintained at not less <br /> than feet . The construction of said driveway shall be in accor- <br /> dance with the Town of Black Earth driveway ordinance. <br /> Vehicular Traffic In the interest of public safety, the operation <br /> of motor vehicles on the described easement real estate shall be in ac- <br /> cordance with the rules of the road of the State of Wisconsin as contained <br /> in Chapter 346 of the Wisconsin Statutes. The owners of Lots 1, 2 , 3, A, <br /> B anc C are authorized to promulgate reasonable rules and regulations go- <br /> verning motor vehicle traffic including reasonable safety measures and <br /> speed limits on the described easement real estate. <br /> Disputes In the event of the commencement of any litigation with <br /> respect to any provision of this Easement & Maintenance Agreement or the <br /> interpretation thereof, and which litigation is contested, the person or <br /> persons prevailing in such litigation shall be entitled to be reimbursed <br /> for the reasonable attorney fees , costs and disbursements actually incur- <br /> red in such litigation from the person or persons not prevailing. <br /> Easement Binding This Easement & Maintenance Agreement is binding <br /> upon and inures to the benefit of each owner of said Lots 1, 2, 3, A, B <br /> and C their heirs , personal representatives, successors and assigns and <br /> -4- <br />
