C3)(S) co NP WE A -I
Re: Joint Petition for Rezoning From -1 to A-2(2) Agriculture District and Application for
Conditional Use, under Sec. . , Dane County Code of Ordinances, for the
seasonal storage of recreational equipment and motor vehicles owned by private
individuals other than those resident on the premises, within the existing accessory farm
buildings. 7873 West Mineral Point Road, Town of Middleton, Dane County.
As owners of the subject lands, we do hereby simultaneously petition for Rezoning from
A-1 to A-2(2) Agriculture District and apply for Conditional Use approval for the seasonal
storage of recreational equipment and vehicles within the existing accessory farm barn and shed
on this 2.78 acre parcel, so that our proposed certified survey map (CSM) of this and adjacent
lands(total of 7.25 acres)may be approved and recorded and also that we will not be forced to
immediately build a residence on this proposed 2.78 acre Lot 2 of the proposed CSM which
would have to equal the floor area of the accessory barn and shed, as required by Sec. 10.04(1)
Dane County Code of Ordinances. The material portion of the zoning ordinance reads as follows:
"On lots in the A-1 Agriculture District where the principal use is residential, more
than one(1)accessory building is permitted, however, the total floor area of the
accessory building or buildings shall not exceed that of the residence on the lot."
In October 1995, the two-family residence on this property was completely destroyed by
fire. We wish to divide the entire 7.25 acre property into 3 parcels for single-family residential
use. Therefore, while the intended principal use is residential, the subject 2.78 acre Lot 2 of the
proposed CSM contains no residence, but an existing ceramic block shed and barn which have
been used for many years for the seasonal storage of recreational equipment and motor vehicles
-- 6 owned by others, as a permitted use in the A-1 Agriculture ture District. We intend to retain these
P E2 `AS ccessory farm buildings which we have extensively repaired, enhanced and converted to the
lo,►Z 1 seasonal storage use, in addition to accessory use fown gardening and property-- ` ±2;
G21` ! maintenance equipment storages. We have also constructed a large screening berm west of the ' S
existingland made many plantings of landscaping trees, shrubs and flowers to improve the
appearance of the parcel. Although we intend to ultimately build a personal residence on the
subject 2.78 acre parcel, we cannot do so at this time and do not wish to be required to build a
residence of equal or greater floor area of the accessory barn and shed, as is required under the
o 4 A-1 Agriculture District zoning cod-
P ''.oPp,( • L to G_t
e 1 Rezoning the 2.78 acre parcel to A-2(2) Agriculture District with the Conditional Use
a pp roval for seasonal sto r age wi ll enable the CSM to be approved and recorded without requiring
either: a)the demolition of the existing accessory farm barn and shed accessory buildings; or b)
immediate construction of a principal residence of equal or greater floor area of the barn and shed.
