COMPOSITE REPORT -page 5 Application No. 6975
B. The width of Miller Farm Rd may present a problem when creating by CSM the two
lots that abut to it. Miller Farm Rd is a public town road with a substandard right-of-
way of 49 foot. The subdivision ordinance requires 66 feet. According to Wis. Stats.
91.77, the county can base its approval for zoning out of Al-EX on the availability of
public facilities in this case the width of a public road:
"(a)Adequate public facilities to accommodate development
either exist or will be provided within a reasonable time."
C. The provision of access easements may present a problem. The owners are proposing
to provide access to the lots over 15 Acres by creating easements (see figure below).
Lot (c.) would have an easement of approximately 300' on top of the previous CSM,
lot (d)would hare a 850' easement on top of cropland, and lot (f) would have a 1,300'
easement on top of cropland too. 500' of the easements in (d) and (f) would be shared.
The proposed easements are the equivalent of at least 3 acres of cropland.
According to the Town Plan, on page 6, chapter f: on Rezoning for nonfarm residential
use states the following:
"(8) The land shall not require crossing of productive agricultural
land to reach the proposed development".
:.: _ :1,4 a ...,.... . -...----- • . .. -, 777 . , 7 ', - ' ' ':::.1 _
T t
yy ,.-
)
's _ (c .
