COMPOSITE REPORT-Page 2 Application No. CUP 1452 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> I. BACKGROUND <br /> A. The applicant is requesting a conditional use permit to allow an outdoor tavern and <br /> outdoor lighted games, including two volleyball courts and a horseshoe pit. Taverns and <br /> lighted outdoor games are conditional uses in the C-2 district. <br /> B. The subject property(Badger Bowl) is in the Town of Madison, near the interchange of <br /> the Beltline and Rimrock Road. It is surrounded on three sides by lands within the City <br /> of Madison. In fact, the majority of Badger Bowl's parking area is within the City(see <br /> Exhibit A). The property is within the Central Urban Service Area. <br /> C. In 1992, the applicant received variances from the Board of Adjustment to zoning <br /> ordinance parking standards, both because the total number of spaces did not meet <br /> standards and the majority of spaces were in another political jurisdiction. <br /> II. ANALYSIS <br /> A. The subject property is currently used as a bowling alley, tavern, and nightclub. There <br /> are approximately 425 off-street parking spaces serving the subject property, with <br /> approximately 360 within the City of Madison. <br /> B. The Beltline and a four-lane section of Rimrock Road are directly north and west of the <br /> property. Lands to the east and south include a mix of commercial and residential <br /> zoning and development. <br /> C. The applicant has constructed an outdoor activity area of approximately 9,200 sq. ft. on <br /> the north side of the existing building. The area covers a space formerly occupied by 32 <br /> parking stalls . It includes two volleyball courts, a spectator area, a bar area(about 500 <br /> sq. ft.), and a horseshoe pit(see Exhibit A). The area is lit by two pole lights and <br /> lighting on the building. It is completely enclosed by a six foot chain link fence. The <br /> applicant indicates that volleyball is currently being played between 6 p.m. and 9:30 p.m., <br /> Monday through Thursday. <br /> D. Staff have reviewed the proposed project against the six conditions for granting a CUP <br /> in S. 10.255(2)(h). The conditions, with staff comments, are summarized as follows: <br /> 1. That the conditional use will not endanger the public health, safety, and welfare. <br /> The area is fenced to restrict access. No apparent health and safety concerns. <br /> 2. That uses, values, and enjoyment of other properties in the neighborhood will not <br /> be impaired by the conditional use. The outdoor activity area is at least 300 feet <br /> from the nearest residence, and is screened from nearby residential districts by the <br /> existing building. Beltline traffic produces far more noise that the requested use. <br /> Still, specific limits on hours of operation would be appropriate. The increased <br /> activity on the property, coupled with the loss of 32 parking spaces, may result in <br /> increased on-street parking. <br /> 3. That the conditional use will not impede orderly development of surrounding <br /> property. All surrounding properties are already developed. <br /> 4. That adequate utilities, access roads, drainage, and other necessary site <br /> improvements will be made. Standard appears to be met, but see#6 below. <br /> 5. That adequate measures are being taken to provide ingress and egress to minimize <br /> traffic congestion. The proposed use is expected to generate additional traffic <br />
