COMPOSITE REPORT-Page 2 Application No. CUP 1452 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> I. BACKGROUND <br /> A. The Madison Country Day School is requesting a conditional use permit to allow use of <br /> an existing school building plus a temporary classroom building for a private school. A <br /> private school is a conditional use under the existing A-2 zoning of the property. <br /> B. The subject property is in the Town of Springfield, within the hamlet of Martinsville. <br /> The property is in a rural area, where public sewer and water services are unavailable. <br /> C. The subject property is currently occupied by St. Martin's Church. The history of the <br /> school use of this property and the school building is described in Exhibit A. Over the <br /> years, the school building has been used as a religious school and a public school, <br /> through CUPs for"religious uses" and"governmental uses" respectively. The CUP for <br /> religious uses is still valid. The proposed private school does not fall under the category <br /> of a"religious use." Therefore, a new CUP is required for Country Day School. <br /> II. ANALYSIS <br /> A. The subject property is currently used by St. Martin's Church. It includes a church <br /> building, rectory, cemetery, private residence, two-story school building(10,000 sq. ft.), <br /> and a paved parking area. St. Martin's parish continues use the school building on a <br /> limited basis for religious education classes. Also on the same legal parcel(but different <br /> zoning lot) as the church is a lighted baseball diamond, for which a rezoning to RE-1 and <br /> CUP were obtained in 1985. All uses share the parking area(see Exhibits B and C). <br /> B. Country Day School proposes to use the existing school building plus a"relocatable" <br /> classroom building for pre-kindergarten through third grade students. The anticipated <br /> enrollment for this school year is 50. Evening and weekend activities are not anticipated. <br /> The School considers this a temporary site pending location to a different site. <br /> C. A site plan showing existing and proposed uses of the subject property is included as <br /> Attachment B. All structures are existing except for the"new relocatable classroom" <br /> which would be 960 sq. ft. in area and have a maximum capacity of 35. The parking <br /> area is also existing, but the stripes shown on the site plan are not yet painted. A small <br /> real estate-type sign has been installed at the entrance to the property. <br /> D. The subject property is within a historic hamlet which is mainly residential in character. <br /> E. Staff have reviewed the proposed project against the six conditions for granting a CUP <br /> in S. 10.255(2)(h). The conditions, with staff comments, are summarized as follows: <br /> 1. That the conditional use will not etdanger the public health, safety, and welfare. <br /> The school use, if kept close to the enrollment anticipated, is consistent with the <br /> historic use of this property. Health, safety, or welfare should not be endangered. <br /> 2. That uses, values, and enjoyment of other properties in the neighborhood will not <br /> be impaired by the conditional use. The proposed use with have similar land use <br /> impacts on adjacent properties as the property's historic use. The school building is <br /> at least 400 feet from nearest residence. No new construction is proposed. Direct <br /> impacts on adjacent residences should be negligible. <br /> 3. That the conditional use will not impede orderly development of surrounding <br /> property. Most surrounding property is already developed. The Town Plan shows <br /> the ag properties to the north and west as an Agricultural Preservation Area. <br />
