EXHIBIT A <br /> CUP 1452 - BACKGROUND INFORMATION <br /> EARLY HISTORY <br /> The building in question was built as a parish school in 1967, having 4 classrooms, a <br /> gymnasium, offices, and an activity area. It was used as a church-related elementary <br /> school until 1969, but the parochial school use could not be continued because no teachers <br /> (nuns)were available. <br /> PREVIOUS REZONE PETITION 3528(DR)/CUP 456 <br /> This rezone to A-2 and RE-1 became effective November 12, 1985; the CUP's became <br /> effective December 17, 1985, including: <br /> • In the RE-1 District, a CUP for a ball diamond"lighted at night" and"sales of alcoholic <br /> beverages by the drink" with restrictions placed on hours of operation for ball games <br /> and other activities; <br /> • In the A-2 District, a CUP for"religious uses" for the church, church school, parish <br /> house, priest's residence, and cemetery, and a CUP for"governmental use" of the <br /> school building near the ball diamond (which was labeled "Middleton School District" <br /> on the site plan submitted.) <br /> GOVERNMENTAL USE <br /> The building was leased to the Middleton-Cross Plains School District in the mid-'80's <br /> and for the 1995-1996 school year. In the latter period, it was used for two kindergarten <br /> classes with a total of about 60 students. The Waunakee School District leased the <br /> building for morning and afternoon kindergarten classes with approximately 160 students <br /> from July 1990 through June 1992. There may have been a period of a year or more when <br /> there was no public school (governmental)use of the building. If so, the CUP for <br /> "governmental uses" expired at the end of that year, but in any case, it definitely expired in <br /> June 1997. <br /> RELIGIOUS USE <br /> Even though the building was being used for public school classes, the parish's agreement <br /> with the school districts allowed the church to use some space for"CCD" or religious <br /> education classes on Wednesday nights, and possibly also on Sundays. This use has <br /> continued to date, through the past 12-month period. <br /> Please note that the CUP for"religious uses" was approved without Conditions, and <br /> covers all the uses listed in the Zoning Ordinance Definition -- "includ(ing), but not limited <br /> to, churches, church-related schools, convents and monasteries" -- so it remains in effect <br /> over the entire A-2 zoned area because of the presence of the church, cemetery, etc., and <br /> is not contingent upon continued religious use of the school building. <br /> Sources: Dane County Zoning Department Records <br /> Clerk,Town of Springfield <br /> Clerk,St.Martin's Parish <br /> Middleton-Cross Plains School District <br /> Waunakee School District 07/24/97 KLS <br />
