That condition provides: <br /> "If the Madison Retriever Club either changes the use of this parcel or sells it,the Club will <br /> petition for a zoning change back to Al-Ex." The proposed condition exceeds the scope of <br /> conditions authorized by D.C. Ord. §10.255(3)(a) and is therefore unlawful. <br /> Section 10.255(3)(a)(2) authorizes conditional zoning "when a restrictive covenant <br /> has been recorded binding the property to conditions specified in the amending ordinance". <br /> The proposed condition does not purport to bind the property. Rather, it is an attempt to bind <br /> the property owner. Such a condition is not appropriate for a restrictive covenant which can <br /> only affect the land. Therefore,the proposed condition is unlawful because it is not <br /> authorized by the conditional rezoning ordinance. Additionally, from a practical <br /> consideration, I do not believe the proposed condition would be enforceable. <br /> It is permissible to condition the rezoning upon a restrictive covenant limiting the use <br /> of the property. But, any attempt to prospectively mandate a future rezone, such as a <br /> reversion to Ag.
