• { • I <br /> DANE COUNTY ORDINANCE PETITION NO. 6444 <br /> Amending Section 10. 03 relating to Zoning Districts in the Town of <br /> Madison <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zoning District Maps of the Town of Madison be amended to include in the <br /> C-2 Commercial District/s the following described land: <br /> Pet. #6444: <br /> Part of the S 1/2 SE 1/4 Section 33, Town of Madison, described as follows: <br /> Commencing at the Southeast corner of the SW 1/4 SE 1/4; thence West on the <br /> South line of said SW 1/4 SE 1/4 66.0 feet; thence North parallel to the East <br /> line of said SW 1/4 SE 1/4, 530.1 feet; thence East 410.7 feet; thence South <br /> parallel to the East line of said SW 1/4 SE 1/4, 49.5 feet; thence East 125.0 <br /> feet; thence South 480.2 feet to a point 472.2 feet East of the Southwest corner <br /> of the SE 1/4 SE 1/4; thence West on the Scuth line of said SE 1/4 SE 1/4, 472.2 <br /> feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3) (a) 2. (b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to the <br /> following conditions. <br /> AMENDED DEED RESTRICTIONS REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the <br /> owner or owners of the land shall record the following amended restrictions on said land: <br /> 1. Permitted uses. Notwithstanding the permitted uses designated for the C-2 Zoning <br /> District, the permitted uses shall be expressly limited to the following: <br /> a. Offices, office buildings and condominium office buildings. <br /> b. Experimental laboratories, manufacturing, assembly plants, <br /> warehousing, storage, distribution centers and wholesale businesses, provided that such <br /> uses shall be further expressly limited and restricted to the present business interests <br /> of Epicentre Technologies Corporation, which include: the isolation of protein from <br /> natural sources, research and development, manufacture and sale of biotech reagents, <br /> kits, instruments, software and other tools for basic research and analysis and other <br /> applications in biology, medicine and agriculture, including diagnostics and <br /> pharmaceuticals. Notwithstanding the foregoing, this restriction and limitation shall be <br /> interpreted to permit any other person or company which operates a business which is <br /> substantially similar to the business operated by Epicentre Technologies Corporation with <br /> respect to the intrusion and offensiveness to the neighborhood related to volume of <br /> traffic, the level of noise, the presence of offensive odors, the hazardousness of the <br /> business, hours of operation and/or any other detrimental factors which would constitute a <br /> nuisance. This restriction and limitation is established to provide an aesthetically <br /> attractive working environment exclusively for and conducive to the development and <br /> protection of offices, research and development institutions, and certain specialized <br /> manufacturing establishments, all of a non-nuisance-type. The essential purpose of the <br /> foregoing is to achieve development which is practical, feasible and economical and an <br /> asset to the owners, neighbors and the community and to promote and maintain desirable <br /> economic development activities in a natural setting. No use shall be conducted as to <br /> cause the harmful discharge of any waste materials into or upon the ground, into or within <br /> any sanitary or storm sewer system, into or within any water system or water, or into the <br /> atmosphere. All uses shall be conducted in such a manner so as to preclude any nuisance, <br /> hazard, or commonly recognized offensive conditions or characteristics, including emission <br /> of dust, gas, smoke, noise not to exceed sixty-five (65) decibels at the property line, <br /> fumes, odors, vibrations, particulate matter, chemical compounds, electrical disturbance, <br /> humidity, heat, cold, glare, or night illumination. <br /> • <br />
