' r <br /> 2. Traffic. All traffic will enter and exit the property via Landmark Place only. At <br /> no time shall any traffic enter or exit via Grandview Boulevard, Coventry Trail or <br /> Nottingham Fray. In addition, a cul-de-sac, with a radius of not less than fifty feet (50) , <br /> shall be dedicated for public use at the south end of Landmark Place, to be located in the <br /> northwest corner of the property, by October 31, 1996. <br /> 3. Side Yard and Rear Yard Requirements. The minimum depth of the side yards and rear <br /> yards shall be as permitted by C2 zoning, with the additional restriction that no <br /> improvements shall be constructed: (a) within the side yards, (b) closer than thirty-five <br /> feet (35') from the southernmost property line; and (c) in the triangle bounded by the <br /> southeasterly corner of the property and then proceeding in a westerly direction along the <br /> southernmost property line for a distance of two hundred feet (200' ) and then proceeding <br /> in a northeasterly direction to the point on the easternmost property line which is one <br /> hundred and fifty feet (150' ) north of the southeasterly corner and then proceeding in a <br /> southerly direction along the easternmost property line to the southeasterly corner. <br /> 4. Screening provisions. The required screening provisions of Section 10.16(7) of the <br /> Dane County Zoning Codes shall be complied with in order to screen residences on adjoining <br /> properties from nuisances which result from the presence of buildings, parking lots, <br /> parking structures, garages, driveways or artificial lighting. Screening shall consist of <br /> the trees and other vegetation which now exist within the rear and side yards set forth in <br /> Section 3 above. The trees and other vegetation will be left substantially in its <br /> existing natural state unless promptly replaced by other natural screening. In addition, <br /> the owner will provide an _--eroreen screen of not less than six feet (6' ) in height along <br /> the rear yard commencing at the southwest corner of the property and proceeding in an <br /> easterly direction for a distance of eighty feet (80' ) .. The owner may, at its sole option, <br /> plant additional trees or other vegetation anywhere on the property. <br /> 5. Building Height Limit. The maximum above-ground height shall be: (a) two (2) <br /> stories in the area designated as the southern one-half (1/2) of the property, and (b) not <br /> greater than four (4) stories, or fifty (50) feet, whichever is less, in the area <br /> designated as the northern one-half (1/2) of the property. For the purposes of this <br /> paragraph, the southern one-half of the property shall be defined as being south of a line <br /> which runs parallel to and two hundred and sixty-five feet (265' ) north of the <br /> southernmost property line. These limitations shall also apply to tanks, storage bins, <br /> silos, towers, and all other improvements to the property. <br /> 6. Epicentre Technologies Corporation understands that it has, and reserves the right, <br /> to apply for amendments to the deed restrictions agreed to herein. <br /> The above restrictions shall be effective when Epicentre Technologies Corporation, or any <br /> other entity in which Gary Dahl owns a majority interest, closes on the purchase of the <br /> property, if within one hundred and twenty (120) days hereafter; otherwise the rezoning of <br /> the property will be void and zoning shall return to RH-1. <br /> Said restrictions shall run in favor of Dane County and the pertinent <br /> Town Board as well as owners of land within 300 feet of the site. Failure <br /> to record the amended restrictions will cause this amendment to be null <br /> and void. <br /> A copy of the recorded document shall be submitted to Dane County Zoning. <br /> Additional Deed Restriction: <br /> 7. Control of drainage from impervious improvements. Owner will work with the City of <br /> Madison engineer to assure that land in the City of Madison will not be adversely affected <br /> by surface water discharge from new impervious surfaces or regrading. In the absence of <br /> storm sewer drainage to the south, owner will drain new impervious surfaces only to the <br /> north side of the property. <br /> EFFECTIVE: March 5, 1996 <br />
