If so, it is incorrect in regard to the <br /> zoning districts described and to the restrictions listed <br /> ??-30-95 ZA Bill Fleck retires sometime in January `95. <br /> 02-07-95 Letter from Pulsfus to Reynolds with copy of Amended Deed Restriction <br /> recorded 12-23-94 (Doc#2651962), and stating"this document was previously mailed <br /> to Mr. Bill Fleck of your office, and Mr. Fleck's notes indicate that he approved of this <br /> document." <br /> 02-28-95 Town of Roxbury Clerk Robert Pings sends Gary Gunderman a copy of the <br /> Amended Deed Restrictions recorded 12-23-94 (Doc#2651962) "adopted by the <br /> Roxbury Town Board. <br /> 02-28-95 CUP 1190 approved by ZNR Comm. with Condition: <br /> 1). Not more than 100 mobile home park trailers. <br /> 03-06-95 Deed Restrictions (Second Amendment) is recorded a second time <br /> (Doc#2663262),with notation: "This document is being re-recorded to correct the <br /> zoning designation on the first page of this document by eliminating the words "To R-1:" <br /> and substituting in its place the correct words"To RE-1." <br /> 03-27-95 Letter from Pulsfus to Reynolds explaining that the Deed Restrictions <br /> (Second Amendment) as re-recorded 01-23-95 (Doc #2656815)was recorded to satisfy <br /> the Zoning Dept.'s"Reminder Notice" requirement"that the wording of the restrictions <br /> may not be altered." See NOTE under 01-23-95, above. <br /> 03-31-95 Letter from new Zoning Administrator Jim Gregorius, stating "all <br /> requirements of the rezoning process have been completed and satisfied." <br /> RECOMMENDATION: Although the 03-06-95 Deed Restriction document was <br /> the "official"one, the 12-23-94 Deed Restriction document more accurately reflects <br /> the Town's 09-19-94 action and the ZNR Comm.'s 10-25-94 action, and it is a legal <br /> document of record Therefore, it should be construed as the applicable Deed <br /> Restriction document for Rezone 6083. <br /> 12/09/97 KLS <br /> h:hist6083.doc <br />
