HISTORY OF REZONE 6461 / C 95 L v C A n o of o <br /> AS IT PERTAINS TO REZO 7110 r u << a C)C (M E r1-1 <br /> -r1 or-3 <br /> 12-04-95 Town of Roxbury action on 6461/1295 for expansion of R-4 area-- <br /> easterly portion(referred to as Parcel B) "with same restrictions as the adjoining <br /> property", i.e.,Deed Restrictions as recorded 12-23-94 (Doc #2651962): <br /> 1. The above described real estate shall be used only for a recreational mobile <br /> home park for so long as said real estate shall be zoned R-4. <br /> 2. The maximum number of mobile homes allowed to be placed on the above <br /> described real estate shall be limited to 100 for so long as said real estate shall be <br /> zoned R-4. <br /> 3. The mobile homes placed on the above described real estate shall only be <br /> occupied from April 1 to November 1 of each year, and any mobile home park <br /> located upon said real estate shall only be operated from April 1 to November 1 of <br /> each year. <br /> 12-12-95 ZNR Public Hearing - no action <br /> 12-26-95 ZNR Work Session - approve amendment to impose a deed restriction that <br /> the only use allowed under the R-4 zoning shall be for a mobile home park. <br /> 04-26-96 Deed Restriction recorded (Doc#2756916)for both Parcel A(Easterly, <br /> expanded R-4 area rezoned under 6461/1295) and Parcel B(Westerly, "original" R-4 area <br /> rezoned under 6083/1190), with 3 restrictions as per Town action 12-04-95. <br /> Effective Date of Rezone 6461. <br /> NOR': The recorded Deed Restriction reflects the Town's wishes, but is not the same as <br /> the action of the ZNR Comm. <br /> 05-14-96 CUP 1295 approved by ZNR Comm. with 2 Conditions: <br /> 1) The maximum number of mobile homes in the R-4 zoned area is to be <br /> limited to 100. <br /> 2) The mobile home [park] shall only be occupied from April 1 to <br /> November 1 of each year and any mobile home park located upon said real <br /> estate shall only be operated from April 1 to November 1 of each year. <br /> NOTE: The 04-26-96 Deed Restriction does not include the the exact wording of the <br /> amendment adopted by the ZNR Committee, but it does accurately reflect the Town's <br /> 12-04-95 action requesting these 3 deed restrictions, and it is a legal document of <br /> record Therefore, it should be construed as the applicable Deed Restriction document <br /> for Rezone 6461. <br /> 12/09/97 KLS <br /> h:hist6461.doc <br />
