<br /> CONDITIONS
<br /> 1. Description of Property and CUP Area. The legal
<br /> description of the Property is the NE'X of the SW'A, the NIAN of the
<br /> SW1,l, the SW1A' of the SW14 and the SOX of the SW'A, all in Section
<br /> 25, T8N, R10E, Town of Burke, Dane County, Wisconsin. The
<br /> description of the CUP Area is set forth in the CUP application
<br /> materials and Section 4 below. The size of the Property and the
<br /> CUP Area are approximately one hundred fifty-nine (159) acres and
<br /> seventy (70) acres, respectively, of which approximately fifty-
<br /> eight (58) acres will be subject to mineral extraction operations
<br /> and approximately twelve (12) acres will be subject to
<br /> stockpiling and related processes and accessory uses. There
<br /> shall be a minimum two hundred fifty (250) foot setback from the
<br /> west perimeter of the Property, a minimum one hundred fifty (150)
<br /> foot setback from the north and south perimeters of the Property,
<br /> and a minimum one hundred fifty (150) foot setback from the
<br /> existing pipeline located under the Property, as per the site
<br /> plans filed with the CUP application materials for purposes of
<br /> buffer zones where no mining will occur.
<br /> 2 . Uses. The operations or activities to be conducted on
<br /> the Property shall include (a) the extraction or removal from the
<br /> earth for sale or use by the Operator of mineral aggregates,
<br /> including limestone, sandstone, gravel, sand, stone or any other
<br /> nonmetallic minerals, (b) the recycling of concrete and asphalt
<br /> for sale or use of by the Operator and (c) related operations or
<br /> activities such as site preparation, excavation, grading,
<br /> stripping leveling and the erection of structures. Such
<br /> operations or activities shall include related processes and
<br /> accessory uses, including, but not limited to, blasting,
<br /> crushing, screening, blending, sorting, stockpiling and
<br /> processing and sale of mineral aggregates or materials.
<br /> 3 . Term/Termination. The term of the CUP shall be thirty
<br /> (30) years, unless sooner terminated in accordance with the
<br /> provisions hereof.
<br /> 4 . Description Of Operations. The mineral extraction
<br /> operations will produce mineral aggregate products, commodities
<br /> or materials for various purposes, including, but not limited to,
<br /> agricultural lime for farming and mineral aggregates or materials
<br /> for construction of buildings and roads. The recycling operation
<br /> will recycle concrete and asphalt only and will produce recycled
<br /> materials for various purposes, including, but not limited to,
<br /> materials for construction of buildings and roads. The
<br /> operations will consist of : (a) stripping topsoil and overburden
<br /> to form berms at the perimeter of the CUP area for the purpose of
<br /> noise reduction, landscaping and reclamation, (b) blasting or
<br /> scraping to loosen rock from the quarry wall, (c) crushing and
<br /> screening of the rock, other aggregate, concrete or asphalt into
<br /> appropriately sized material to meet governmental, farming and
<br /> construction specifications, (d) stockpiling the crushed rock,
