Operator and representatives from the Town, the County and ANR <br /> Pipeline Company shall be permitted to inspect the same following <br /> each blast . <br /> E. Berms. Operator will build berms in accordance <br /> with the plans filed with the CUP application materials for the <br /> purpose of mitigating any noise, visual and safety concerns of <br /> the neighbors. The berms shall be seeded. The berms will have a <br /> minimum height of seven feet and a maximum height of twenty feet, <br /> with 3 to 1 slope on both sides. The berm to be built along the <br /> west perimeter of the Property (and along Reiner Road) will be <br /> constructed in phases according to the plans filed with the CUP <br /> application materials. Construction of the Phase 1 berms will <br /> commence when the Operator has all permits necessary to conduct <br /> the mineral extraction operation and will be completed within six <br /> (6) months, subject to excusable delay for adverse weather, <br /> adverse planting conditions (for seeding) and force majeure. <br /> Construction of Phase 2 berms will be completed before the <br /> commencement of significant Phase 2 operations. The Operator may <br /> use the Phase 1 berms for reclamation. Operator will use every <br /> effort to preserve the screening along Reiner Road. At all times <br /> during the term of this Agreement, Operator shall require all <br /> trucks entering and leaving the quarry to have proper muffler <br /> systems and controls which meet or exceed the then most current <br /> industry standards for noise abatement and shall similarly <br /> require all crushing equipment to meet or exceed the then most <br /> current industry standards for noise abatement. <br /> F. Hauling. The only entrance to the quarry shall be <br /> a haul road on Reiner Road according to the plans filed with the <br /> CUP application materials. The existing entrance to the <br /> farmhouse from Reiner Road will be maintained. Additional access <br /> points may be allowed for agricultural uses on the Property. The <br /> haul road will be maintained in a dust-free manner in accordance <br /> with all applicable local, state, and federal laws and <br /> regulations. Except for neighborhood deliveries, all trucks <br /> hauling limestone, sandstone, sand or gravel from the quarry, <br /> when exiting north from the quarry or coming from the north to <br /> the quarry, shall use only the truck route described as Reiner <br /> Road to Nelson Road to Highway 151, and when exiting south from <br /> the quarry or coming from the south to the quarry, shall use only <br /> the truck route described as Reiner Road to County Highway T, <br /> subject to the continued availability of such routes and no <br /> unreasonable expense and requirements. <br /> Except for hauling agricultural lime, hauling of <br /> material from the CUP area will be restricted to Monday through <br /> Saturday. Hours of hauling shall be 7: 00 a.m. to 9 : 00 p.m. , <br /> Monday through Saturday during the months of January, February, <br /> June, July, August, September, October, November and December. <br /> Hauling may be done after 9 : 00 p.m. during the months of March, <br /> April and May. Except for hauling agricultural lime, there will <br /> be no hauling allowed on Sundays or legal holidays. <br />
