RSCOMMENDAAION
RE: CUP 1298
The Planning Commission of the Town of Burke conducted a
public hearing on January 10, 1996, regarding application for
Conditional Use Permit No. 1298, ("CUP 1298") for a mineral
extraction quarry at the Ed Reiner Property, located at 5060 Reiner
Road. Additionally, the Planning Commission received information
regarding CUP 1298 at its meetings on December 13, 1995, and
January 24, 1996. After fully considering all of the information
it has received regarding CUP 1298, the Planning Commission, at its
meeting on February,, 1996, makes the following recommendations to
the Town Board:
The Planning Commission recommends that the Town Board
for the Town of Burke recommend to the Dane County Zoning
Committee that the application for CUP 1298 be denied.
If the Town Board, or subsequently, the Dane County
Zoning Committee or Dane County Board, declines to accept
the above recommendation, the Planning Commission further
recommends that the Town Board request that conditions be
place on CUP 1298 and specifically agreed to between the
OW CUP applicant and the Town of Burke to mitigate
and/or avoid negative impacts arising from the mineral
extraction quarry operation and that the Town of Burke be
allowed to make recommendations regarding such
conditions, with the Town's Planning commission to hold
a public hearing and make recommendations to the Town
Board concerning conditions to be placed on CUP 1298 .
In making these recommendations, the Planning Commission finds:
1. A mineral extraction quarry is not consistent with the
significant residential uses (inventoried at within
radius) that have developed and are continuing to
develop in the area of the proposed quarry site and is not
consistent with the draft land use plan that is under
consideration by the Town of Burke and anticipated to be
submitted to the electorate for approval in April 1996.
2. ' The establishment, maintenance and operation of a mineral
extraction quarry will be detrimental to or endanger the
public health, safety, comfort and general welfare in the
following respects:
a. The proposed quarry site is located very near a high
pressure 12 inch natural gas main; quarry operations
including blasting and truck and heavy equipment movement
pose a significant risk of causing a rupture or leak of
this main, with resulting explosion or fire and damage to
surrounding properties, including residences. At this
point in time, there are no state or federal regulations
