The Zoning Administrator may require detailed site grading plans of existing and proposed conditions to be <br /> submitted before commencement of land disturbing activities. <br /> *Ordinance Amendment 16, 2009-2010: Amending Chapter 10 and Chapter 11 of the Dane County Code <br /> of Ordinances, Regarding Preservation Topography Near Property Lines: Section 10.04 ...(6)cr., OA 16, <br /> 2009-10,pub. 11/19/09 <br /> Section 10.25 ADMINISTRATION,ENFORCEMENT AND PENALTIES. (1)Zoning administrator. (2) <br /> Zoning permits. (a)No new building shall hereafter be erected,and no existing building shall be added to, <br /> structurally altered,moved or changed in use, nor shall any nonconforming building be repaired or restored, in any <br /> district,until a zoning permit has been issued, except as otherwise provided by law or ordinance. <br /> *Ordinance Amendment 4,2011-2012: Amending Chapter 10 of the Dane County Code of Ordinances, <br /> Regarding Accessory Structure: Section 10.04 ...(1)(b) and(1)(c) am., OA 4, 2011-12,pub. 08/01/11 <br /> Upon review of the complaint, it is determined that construction of the agricultural accessory structure was <br /> completed in 2013. <br /> Per Dane County Land and Water Resources Urban Erosion Control Analyst, Ryan Shore,an erosion control <br /> permit for agricultural structures was not a requirement until January 2014. The site has been inspected by Mr. <br /> Shore and determined that the condition of the site is typical of areas where quarrying work has occurred, and <br /> while not fully vegetated it appears to be generally stable with any sediment being deposited in Mr. Wipperfurth's <br /> property, not on adjacent lands. No erosion control permit or additional stabilization will be required. <br /> In addition,under DCCO CHAPTER 11 SHORELAND,SHORELAND-WETLAND AND INLAND- <br /> WETLAND REGULATIONS DCCO 11.03 SHORELAND REGULATIONS: <br /> Section 11.03(3)Impervious Surface Limits. Within three hundred(300)feet of the ordinary highwater mark of any <br /> navigable waterway, construction, reconstruction,expansion,replacement or relocation of any impervious surface <br /> shall comply with all of the following standards... <br /> Dane County Assistant Zoning Administrator, Hans Hilbert, has conducted a navigability study of the intermittent <br /> stream located within 300 feet of the agricultural accessory structure. The stream has been deemed non-navigable. <br /> No Shoreland Zoning Permit will be required. <br /> This letter serves as a final notice that your property at 6755 County Highway P is in violation of the Dane County <br /> Code of Ordinances, Chapter 10 Section 10.04 and Section 10.25 as noted above. <br /> Please provide to our office sufficient evidence that your property is in compliance with Chapter 10. Acceptable <br /> evidence should be in the form of a topographical survey prepared by a licensed surveyor. <br /> A zoning permit must be obtained from Dane County Zoning at(608) 843-4163 within 28 days of the date of this <br /> letter.
