TOWN of VIENNA <br /> 5270 Norway Grove Road;DeForest,Wisconsin 53532 <br /> March 5, 1996 <br /> Dane County Zoning <br /> City-County Bldg., Rm 116 <br /> 210 Martin Luther King Jr., Blvd <br /> Madison, Wisconsin 53709 <br /> Re: Zoning Petition # 6541 <br /> Dear Sirs: <br /> The Vienna Town Board and Vienna Plan Commission approved Zoning <br /> petition # 6541, by Brad Horning, for a change from R-1 to R-3 with <br /> restrictions which only allow use of the property for a single family <br /> residence. The approval was granted at the March 4th Vienna Town Plan <br /> meeting and the March 4th Vienna Town Board meeting. <br /> In granting approval, both the Board and the Plan committee, found this to be <br /> a non-conforming use- but with special circumstances which allowed a <br /> variance from the Town Plan. Those being: <br /> 1) unusual lot configuration which limited the use of the lot for a building addition <br /> due to the rear yard set-back requirements in the R-1 District <br /> 2) the topography of the lot placed severe limitation on placement and design of <br /> the original improvements on that lot <br /> 3) there is one owner of the property on each side and to the rear of that property <br /> who was in agreement with the change with conditions (single family only)to <br /> effectively allow relief from the rear yard set-back requirement-which would <br /> allow a home addition on that lot <br /> 4) the lot was unique in shape and limitations to other lots in that subdivision area <br /> The Town supports approval of zoning request # 6541 and asks that Dane <br /> County Zoning grant the zoning change with the condition it be restricted to <br /> a single family use only- and be subject to other requirements in the R-1 zone <br /> with the exception of the relief of the R-1 rear yard set-back requirement. <br /> Sincerely, <br /> Robert Pulvermacher <br /> Vienna Town Clerk <br />
