Approve the rezoning of proposed Lot 2 from A-1 Exclusive to A-2 in conformity <br /> with Exhibit 3 attached hereto. This is necessary because the resulting Lot 2 has <br /> net acreage (net of highway right-of-way) of less than 35 acres. <br /> 4. Find that the rezonings of proposed Lots 1 and 2 out of A-i Exclusive meet the <br /> following conditions: <br /> A. That adequate public facilities to accommodate development either exists <br /> or will be provided within a reasonable time; <br /> B. That provision of the public facilities will not place an unreasonable <br /> burden on the affected local units of government; and <br /> C. That the land proposed for rezoning is suitable for development and this <br /> development will not result in undue water or air pollution, cause <br /> unreasonable soil erosion or have an unreasonably adverse effect on rare <br /> or irreplaceable natural areas. Please see Exhibit 4 attached hereto. <br /> 5. We would further request that the approval of the Town Board be subject to the <br /> following contingencies: <br /> A. That any further subdivision be subject to the approval of the Town and <br /> the County; <br /> B. That any conditional use under the A-2 zoning classification be subject to <br /> the affirmative approval of the Town; and <br /> C. That Mr. Harold Bewick (the land contract vendor/seller) confirm in <br /> writing that he concurs with the proposed subdivision and rezoning of the <br /> property, that he joins in the petition for subdivision and rezoning to the <br /> extent that he has an interest in real estate; and that he does not have any <br /> plans of his own for the property different from what has been presented <br /> by David Wood. <br /> We thank you for all the time that you have given us in working with us on what has <br /> become and grown to be a very complex matter. <br />
