Variance. Two documents which should be considered are: County Zoning Standards for <br /> all conditional use requests and conditional uses for A-1 property(the zoning which this <br /> request is being taken. <br /> Conditional Use Standards <br /> 1) That the establishment, maintenance, or operation of the conditional use will not be <br /> detrimental to or endanger the public health, safety, comfort, or general welfare. <br /> A-this request shows no reason to believe any of this standard to apply negatively. <br /> 2)That the uses, values and enjoyment of other property in the neighborhood for <br /> purposes already permitted shall in no foreseeable manner substantially impaired or <br /> diminished by establishment, maintenance or operation of the conditional use. <br /> A- this use already exists as a non-conforming use and has done so without complaints <br /> for the past several years. Surrounding land uses do not seem in conflict- and are <br /> predominantly agricultural in nature. This use would seem compatible in an <br /> agricultural area- and may be the best possible use of property which is deemed not <br /> reasonably suitable for other agricultural uses- residential expansion not allowed <br /> 3) That the establishment of the conditional use will not impede the normal and orderly <br /> development and improvement of the surrounding property for uses permitted. <br /> A- The Vienna Town Plan prohibits any other uses in the area other than Agricultural <br /> and agricultural farm owners children's residential uses. <br /> 4)That adequate utilities, access roads,drainage and other necessary site improvements <br /> have been made or are being made. <br /> A- no additional utilities, roads, or drainage seem necessary for this "limited use" <br /> 5) That adequate measures have been or will be taken to provide ingress and egress so <br /> designated as to minimize traffic congestion in the public streets <br /> A- no road problems will increase due to this "limited use" <br /> 6)That the conditional use shall conform to all applicable regulations of the district in <br /> which it is located. <br /> A- this request if granted would meet the above requirement with a Town Plan <br /> Variance. <br /> Conditional uses in the A-1 Agricultural District <br /> 1)Statement of purpose of the zoning ordinance and the A-1 District <br /> A- preservation of Agricultural lands and orderly development <br /> B- this proposal is for land not suited for normal agricultural use and would encourage <br /> orderly development by it's best use <br /> 2)The potential for conflict with agricultural uses <br /> A- this use is considered to have no impact with existing agricultural uses or any <br /> foreseen agricultural uses in the future <br /> 3)The need of the proposed use for a location in an agricultural area <br /> A- the Vienna Town Plan has not designated area for LC-1 uses and agricultural <br /> land would be needed for any such designated use- be it here or elsewhere <br /> 4)The availability of alternate locations. <br />
