COPY <br /> DEVELOPMENT AGREEMENT <br /> THIS AGREEMENT, made and entered into by and between the Town of Windsor, a <br /> body corporate and politic (the "Town") and Tiziani/Stricker Properties LLC., a Wisconsin <br /> Limited Liability Corporation, (the "Developer"). <br /> WITNESSETH <br /> WHEREAS, Developer has filed for Rezoning and Site Plan approval to permit the <br /> construction of two 16 unit apartment buildings, each containing eight one-bedroom units and <br /> eight two-bedroom units, on Lot 3 of CSM # 7694, recorded in Volume 40 Certified Survey <br /> Maps, page 155, Document No.2652344, located in Section 32, Township 9 North, Range 10 <br /> East, Town of Windsor, Dane County, Wisconsin, (the "Subject Realty"); and, <br /> WHEREAS, the Town and Developer agree that the development of the Subject Realty, due <br /> to its proximity to Lake Windsor, and other environmentally sensitive areas, should be subject <br /> to additional specific restrictions in order to mitigate impacts on water quality, aesthetics and <br /> neighborhood character. <br /> NOW, THEREFORE, in consideration of the covenants hereinafter set forth and other good <br /> and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the <br /> parties hereby mutually agree as follows: <br /> 1. Rezoning. The Town Board shall recommend to Dane County, approval of the <br /> rezoning of the Subject Realty to the R-4 Residential classification to permit the <br /> construction of two apartment buildings per the approved site plan. <br /> 2. Site Plan. The Town Board shall approve the Preliminary Site Plan attached hereto as <br /> Exhibit A which provides for the general development of the Subject Realty in <br /> addition to the terms of this agreement. The Preliminary Site Plan and this agreement <br /> restricts the use of the Subject Realty to not more than two apartment buildings each <br /> containing eight one-bedroom units and eight two-bedroom units, and related facilities <br /> including paved parking areas, fenced dumpster areas and landscaping. Town Board <br /> approval of the Preliminary Site Plan does not constitute any approval or presumption <br /> of approval of on-site stormwater drainage control improvements. <br /> 3. Conditions Precedent to Construction. Developer shall not commence any site <br /> development work or building construction prior to the Town Business Manager <br /> determining the following conditions have been satisfied: <br /> Tizianni/Stricker <br /> Development Agreement <br />
