• <br /> COMPOSITE REPORT-Page 2 Application No.6629 <br /> STAFF COMMENTS <br /> BACKGROUND <br /> A. The applicant owns-11 acres of land in the town of Medina occupied by a <br /> dead livestock processing facility and residences for the workers of the <br /> facility. The site is a mix of commercial and residential, two uses quite <br /> incompatible considering the air pollution of such a processing facility. <br /> B. The land adjacent and north of the property has been annexed by the <br /> Village of Marshall and is planned for residential development. There <br /> is a cemetery to the West, the Maunesha River to the East, and Highway <br /> 19 to the South. <br /> C. Multiple rezones have occurred on the property. Presently-5 <br /> acres are in C2, -3.5 acres are in R-1A,R-3 and R-4, and 2.6 acres remain <br /> in RH-1. These 2.6 acres in RH-1 are currently occupied by a residence <br /> and also used to park trucks. The applicant is requesting to rezone them <br /> into C2 (1.45 acres) and R-1A(1.15 acres). The C-2 portion of the <br /> parcel would be used for a truck shelter. Rezoning the remaining portion <br /> of the parcel to R-1A would then become necessary for that residential <br /> parcel to retain zoning lot area compliance. <br /> II. ANALYSIS <br /> A. The applicant is proposing to build a truck shelter covering an <br /> area already used for parking trucks. Environmental Health <br /> staff have no objections. <br /> B. Without increase in business, traffic flow should remain the same, accessing <br /> the truck shelter directly through West Waterloo Road or through the <br /> private road that divides the property(from West Waterloo to Karem <br /> Drive). The County Highway Department has no comments on the <br /> proposed rezoning. <br /> C. The land proposed for C-2 zoning is currently used for outdoor truck <br /> parking. Parking trucks is not allowed in RH-1(see 10.16 (c) 5: "Trucks, <br /> whose gross vehicle weight exceeds twelve thousand(12,000)pounds,semi-tractors and <br /> semi-trailers shall be stored or parked only in the C-2 commercial or M-1 industrial <br /> districts,except as otherwise provided by this ordinance"). The existing residence is <br /> consistent with RH-1 zoning because its lot size is currently greater than <br /> the minimum of two acres. <br /> D. The proposed use of building a truck shelter is consistent with C2 zoning <br /> and the residence with its lot size consistent with R-1A zoning. <br />
