John and Ardell Dahl - March 23, 1995 <br /> 3. <br /> the plat so that the construction conditions contained in this approval <br /> can be amended to reflect changes in lot configurations or numbering, a <br /> complete legal description of the property shall also be provided so <br /> that a variance approval document can be prepared by the Department <br /> which you will be required to record with the Dane County Register of <br /> Deeds and so that Wisconsin Unique Well Number can be assigned to each <br /> individual proposed well. <br /> 12. That any prospective buyers of any of the lots in the Subdivision that <br /> have special casing requirements shall be provided with the most current <br /> copy, in the event of revisions, of this approval. <br /> 13. That any well driller contracted to construct a well on any of the lots <br /> with special casing requirements shall be provided with a copy of this <br /> approval and it shall be the responsibility of both the owner of the lot <br /> at the time a well is constructed and the well driller to see that the <br /> conditions of this approval are met. <br /> 14. That in the event that the actual construction of any of the wells on <br /> the above-described property has not commenced within 2 years of the <br /> date of this approval, the approval shall become void for each <br /> individual well. <br /> Failure to comply with any term or conditions of this approval voids the <br /> approval. You are also responsible for acting in compliance with all other <br /> applicable statutory and administrative code requirements. <br /> As authorized by Susan L. Sylvester, Administrator, Division for Environmental <br /> Quality. <br /> NOTICE OF APPEAL RIGHTS <br /> If you believe that you have a right to challenge this decision, you should <br /> know that Wisconsin statutes and administrative rules establish time periods <br /> within which requests to review Department decisions must be filed. For <br /> judicial review of a decision pursuant to sections 227. 52 and 227. 53, Stats . , <br /> you have 30 days after the decision is mailed, or otherwise served by the <br /> Department, to file your petition with the appropriate circuit court and serve <br /> the petition on the Department. Such a petition for judicial review must name <br /> the Department of Natural Resources as the respondent. <br /> To request a contested case hearing pursuant to section 227.42, Stats. , you <br /> have 30 days after the decision is mailed, or otherwise served by the <br /> Department, to serve a petition for hearing on the Secretary of the Department <br /> of Natural Resources. The filing of a request for a contested case hearing is <br /> not a prerequisite for judicial review and does not extend the 30-day period <br /> for filing a petition for judicial review. <br /> All hearing requests must be made in accordance with s . NR 2.05(2) , Wis. Adm. <br /> Code, and must identify the grounds for the petition and the desired <br /> modification or change to the Order and include specific information <br /> demonstrating the following: <br />
