COMPOSITE REPORT - Page 2 Application No. 6750. CUP 1380 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> BACKGROUND <br /> A. The applicant is requesting rezoning from two districts A-1 EX(2 acres) and A-2, <br /> to A-2(2). The intent written in the Application Information Sheet is to "convert <br /> school to church". The new rezone would provide zoning compliance for the <br /> existing parcel and the CUP would allow for religious uses. <br /> B. The subject property is 3.3 acres in size and has a school building in it,the former <br /> Springfield Elementary School, composed of eight classrooms - four of the <br /> classrooms are temporary buildings- and a gym. A pond occupies part of the <br /> property and a quarry is in the property adjacent to the South. <br /> II. ANALYSIS <br /> A. If the intention of the applicant is just to renovate the gym and transform it into a <br /> chapel as stated in the application, no additional structures or major changes to the <br /> property are intended. The proposal seems "reasonably compatible with its past <br /> use (see RPC comments). <br /> B. In a letter dated September 17, 1996,the applicant states: "We are also applying <br /> for a conditional use permit for religious use for a chapel.parochial school, and a <br /> residence for pastor or caretaker on the 3.3 acre parcel." If the intention of the <br /> applicant is to obtain a CUP for all such changes at this point in time, a site plan <br /> with those changes should have been provided, as well as more specific <br /> information on the use of the property (number of students for the school, size and <br /> location of the residence, number of parking stalls, ...). Such information is <br /> necessary for proper review by Dane County Staff such as location of well, septic <br /> system, traffic patterns, building setbacks, ..etc. <br /> C. In the site plan, a triangle is drawn with: "approximate buildable area= 1.3 <br /> ACRES". Such triangle is covered in part by a navigable pond as determined in <br /> the Wisconsin Wetland Inventory Map of 1986. A setback for buildings near a <br /> pond is required to be not less than 75 feet by the shoreland regulations (Dane <br /> County Code of Ordinances Chapter 11.03 (2)). Therefore all 1.3 additional acres <br /> stated in the site plan are not "buildable" in this property. <br /> D. If the CUP was approved based solely on religious uses as a conditional use <br /> permitted in A-2, (chapter 10.126.(3)(f)),the ZNR Committee could be approving <br /> further alterations to the property than the one applied for at the time of the <br /> application, without any review by Dane County Staff. Such alterations are <br /> included by definition in Chapter 10.01 of the Code of Ordinances (51a): <br /> "Religious uses. Shall include but not be limited to churches, church related <br /> schools, convents, and monasteries." <br />
