The landowner was instructed in 2001 (see attached correspondence <br /> from Planning&Development and WIDNR)that a wetland delineation needed to be completed to determine the <br /> precise boundaries of the large wetland on the property. <br /> The landowner has apparently had a field delineation completed by the U.S. Army Corps of Engineers in June of <br /> 2001. However,this field work was apparently never sent to the Wisconsin Department of Natural Resources for <br /> review,as required by state and federal law. This property will be subject to stormwater and erosion control permits <br /> under Chapter 14 of the Dane County Code, including approval of a stormwater and erosion control plan and <br /> installation of any necessary management practices. The property is within the watershed of Token Creek,a cold- <br /> water fishery sensitive to thermal impacts. Practices to reduce the temperature of runoff from the site will be <br /> required. <br /> Recommended conditions of approval: <br /> The committee may wish to impose a 90-day delayed effective date on this petition,by which time the landowner <br /> must accomplish the following: <br /> a. Receive DNR approval offield-delineated wetland boundaries on the site. If necessary, the boundaries of the <br /> proposed C-2 zoning shall be adjusted to avoid wetland areas. <br /> b. Successfully obtain a stormwater and erosion control permit from the Department of Planning&Development <br /> under Chapter 14 of the Dane County Code. <br /> c. Provide to the zoning administrator a site plan and landscaping plan approved by the Town of Burke Board of <br /> Supervisors. Landscaping shall conform to s. 10.16(7) of the Dane Co. Code. <br /> d. Record with the Register of Deeds deed restrictions, in a form approved by the zoning administrator, that limit <br /> permitted uses to `parking or storing of motor vehicles."[s. 10.14(1)(q), Dane County Code] <br />
