CONDITIONAL USE PERMIT# 1405 by Huston Holdings LLC to allow mineral extraction site on property <br /> located North and East of 2494 Nora Road in part of the E 1/2 SE 1/4 Section 16, Town of Cottage Grove. <br /> Motion by Kesterson/Cornwell to impose the following conditions: <br /> 1. The applicant shall submit an erosion control plan covering the entire CUP area for the duration of <br /> operations, and receive approval of an erosion control permit prior to commencing extraction operations. <br /> 2. The applicant shall apply for and receive a special exception permit for any lands proposed for excavation <br /> which are within the shoreland area as designated in Chapter 11,Dane County Ordinances, and a flood zone <br /> permit for any lands proposed for excavation which are within the floodplain area as designated by FEMA <br /> floodplain maps. The applicant may begin operations on lands outside the shoreland and floodplain areas <br /> } before receipt of such permits. <br /> The applicant shall apply for and receive all other required local, state and federal permits, including but not <br /> limited to a zoning permit from the Zoning Division. <br /> 4. Operations shall cease no later than eight years from the date of CUP approval. <br /> 5. Reclamation shall be completed within one year after operations have ceased, and shall follow the applicant's <br /> submitted"Restoration Plan"and"Reclamation Summary." The operator shall post and maintain at all times <br /> during the term of the CUP a bond in favor of the County in the amount of$25,000 payable to Dane County <br /> to ensure compliance with the reclamation plan. <br /> . The excavation area shall be enclosed with a woven wire fence aligned as shown on the submitted"Site <br /> Initiation Plan." The fence shall have one strand of barbed wire on the top, with a total height of not less <br /> than five feet. The haul road and any other access points shall have gates securely locked when the extraction <br /> site is not in operation. The site shall be signed"no trespassing." <br /> The gravel drive immediately east of the 2494 Nora Road property shall be removed. <br /> The operator shall create and maintain throughout the term of the CUP a landscaped earthen berm, not less <br /> than 12 feet in height, located south of the extraction operation as delineated on the"Site Initiation Plan." <br /> The berm shall be seeded. <br /> The operator shall pave with asphalt the haul road(driveway)as shown on the"Site Initiation Plan,"and <br /> shall maintain the haul road in a dust free manner in accordance with local, state, and federal regulations. <br /> W. Hours of operation, except for crushing, shall be from 6:00 a.m. to 5:00 p.m.,Monday through Friday,and <br /> from 8:00 a.m. to 1:00 p.m. on Saturdays. Crushing shall not occur before 8:00 a.m. on any day. No <br /> operations of any kind shall take place on Sundays or legal holidays. Hours of operation may be temporarily <br /> { extended for special circumstances,but only after approval by the Town Board. <br /> There shall be no blasting or drilling on the site. <br /> The operator shall use spray bars (water)in the crushing process to reduce dust.
