COMPOSITE REPORT-Page 4 CUP No. 1405 <br /> III. SUMMARY <br /> A. The main issues surrounding this proposed CUP relate to its potential impacts on <br /> surface and ground water, surrounding residential properties, and nearby roads. <br /> B. The ZNR Committee may wish to defer action on this request until remaining <br /> issues can be resolved and appropriate conditions developed. The following issues <br /> may form the basis for discussions with the applicant and conditions of approval. <br /> 1. The applicant will have to apply for and receive a special exception permit <br /> from the Board of Adjustment for earthmoving activities in the shoreland <br /> area. An erosion control plan may have to be submitted in this process. <br /> 2. All town conditions should be incorporated into CUP approval. <br /> 3. The proposed berm south of the subject property should be designed to <br /> block visibility from nearby residential properties along Nora Road. If the <br /> proposed use would be visible from the new house to the northwest, <br /> berming or landscaping should be included in this area as well. <br /> 4. More detailed plans for dust and noise mitigation should be considered, <br /> particularly given the potential use of a crushing plant. Alternatively, the <br /> ZNR Committee could consider allowing use of a crushing plant if the <br /> applicant later applied for and received approval of a CUP amendment. <br /> 5. Hours of operation should be reevaluated given nearby residences. <br /> Specifically, a later weekday start time should be considered. <br /> 6. A timetable should be developed for both the completion of operations and <br /> reclamation. That timetable could form the basis for the ZNR Committee <br /> establishing a maximum time period in which the CUP would be valid, and <br /> the site restored. <br /> 7. The applicant should consider phasing operations and reclamation so that a <br /> minimum amount of area is open at one time. Reclamation should be <br /> consistent with both the submitted plan map and written summary. <br /> 8. The ZNR Committee should consider requiring that the applicant improve <br /> the intersection of CTH N and Nora Road, if such improvement becomes <br /> necessary as a result of the proposed use. <br /> 9. The "site initiation plan" should be revised to show(a)the location of the <br /> new house to the northwest; (b)the location of the intermittent <br /> stream/drainage ditch and floodplain boundaries; (c)the locations and type <br /> of surfacing of all proposed driveways; (d)the surface water drainage pond <br /> proposed by the applicant in written materials; (e)the "landscaped buffer" <br /> also proposed; (f)berming and/or landscaping to screen the operation from <br /> all nearby residences; (g) the type of fencing proposed; (g) the locations for <br /> operation and storage of all machinery, structures, and equipment; and (g) <br /> phasing of the operation as appropriate. <br /> 10. The potential impact on the groundwater supply of operating and storing <br /> equipment below the groundwater level should be explored. <br /> 11. Staff should research other conditions imposed on recent mineral extraction <br /> operations to assure that a consistent set of conditions is required. <br />
