Since <br /> then, staff and the applicant have had discussions to attempt to resolve some of these issues. <br /> Progress made on each of the eleven points is addressed as follows: <br /> 1. Special Exception Permit: The applicant has indicated that he was not previously aware of a <br /> special exception permit requirement for excavation on the subject property. The applicant <br /> may request that the Zoning Administrator make a determination whether the adjacent <br /> waterways are in fact navigable, which triggers the special exception permit requirement. In <br /> any case, the applicant will have to submit an erosion control plan and receive an erosion <br /> control permit for operations on the entire property. The erosion control plan should ideally <br /> be submitted before the Committee acts on the CUP request. If any excavation is planned <br /> within the FEMA designated floodplain on the property, the applicant will also have to obtain <br /> a flood zone permit from the Zoning Division. <br /> 2. Town Conditions: The applicant does not oppose the town conditions. <br /> 3. Screening Berm: According to the applicant, the berm as proposed would block visibility of <br /> the operation from the two houses on Nora Road. The berm will be seeded. More detail <br /> should be provided on the height and slope of the berm. The new house to the northwest of <br /> the proposed operation is occupied by the owner of the subject site. No screening is <br /> proposed in this area. <br /> 4. Noise/Dust Mitigation: The applicant indicates that the Town did not express any concerns <br /> with noise or dust mitigation beyond those already addressed (e.g., paved driveway). Based <br /> on conditions on previous mineral extraction site approvals, it still may be appropriate to <br /> consider more detailed plans or conditions for noise and dust mitigation(e.g., spray bars on <br /> crusher, mufflers on trucks and equipment). <br /> 5. Hours of Operation: The applicant states that the proposed hours of operation were <br /> developed through negotiations with the Town. Further, public informational meetings were <br /> held in the area. A review of recent mineral extraction site approvals suggests that 6:00 a.m. <br /> is an early but not unprecedented start time. <br /> 6. Timetable: According to the applicant, the Town has approved a permit for a five year <br /> operation. The applicant believes that the extraction process could take anywhere from three <br /> to eight years. A deadline for both the completion of operations and reclamation should be <br /> included as part of this CUP approval. The applicant also indicates a willingness to provide a <br /> bond to ensure reclamation as planned. <br />
