<br /> Construction of a deck without an issued Dane County Zoning Permit
<br /> Dear Ms. Blood:
<br /> On January 26,2016 a site inspection was conducted for the home addition as permitted in Dane County Zoning
<br /> Permit#2015-00755. Upon inspection it was observed a rear yard deck addition had been constructed without
<br /> issued zoning approvals.
<br /> Under Dane County Code of Ordinance Chapter 10: Zoning:
<br /> Section 10.25 ADMINISTRATION,ENFORCEMENT AND PENALTIES. (1)Zoning administrator. (2)
<br /> Zoning permits. (a)No new building shall hereafter be erected,and no existing building shall be added to,
<br /> structurally altered,moved or changed in use, nor shall any nonconforming building be repaired or restored, in any
<br /> district,until a zoning permit has been issued,except as otherwise provided by law or ordinance.
<br /> Section 10.01 DEFINITIONS(7)Building.Any structure having a roof supported by posts, columns or walls and
<br /> its appendages including, but not limited to balconies,porches, decks, stoops,fireplaces and chimneys. Also
<br /> included for permit and locational purposes are swimming pools, both above and below ground,permanent hunting
<br /> blinds with a foundation,and towers, including communication towers.Not included within the definition,for
<br /> permit purposes or otherwise, are poles,towers and posts for lines carrying telephone messages or electricity and
<br /> recreational structures of open construction and without walls, such as swing sets, slides,yard gyms, climbers, sand
<br /> boxes and teeter totters.
<br /> (71)Building footprint. The entire area of ground covered by a structure, expressed in square feet, including
<br /> appurtenances such as,but not limited to,balconies, porches,decks, stoops,fireplaces,and chimneys.
<br /> Furthermore, Section 10.07 R-3 RESIDENCE DISTRICT. (7)Side yard requirements.The minimum width of
<br /> any side yard shall be 10 feet.
<br /> A Plat of Survey submitted by Madison Survey Associates, Inc to Dane County Zoning on November 2,2015,for
<br /> the 866 square foot home addition, is enclosed.
<br /> A second Plat of Survey is enclosed indicating a reduced size for the rear yard deck addition to the 866 square foot
<br /> home addition.
