The Town Attorney shall review and approve all deed restrictions and <br /> condominium rules and by-laws proposed by the Developer prior to the Clerk's <br /> signature on the Plat. <br /> 11, The Developer shall comply with any rules, regulations, and permits of <br /> County, State or Federal agencies with respect to the sewerage system, wells, erosion <br /> control, stormwater drainage control, and construction erosion and drainage control <br /> measures, as well as all provisions of Town Ordinances. <br /> 12. A waiver shall be granted to the Developer for this parcel from any <br /> shoreland access requirements of the Town Land Division Ordinance due to the finding <br /> of the following: <br /> (a) The granting of this variance is necessary to avoid having the <br /> public safety, health and welfare harmed, and to prevent injury to other property <br /> or improvements in the surrounding area, due to increased traffic problems, <br /> increased parking concerns, potential trespassing, and potential property damage <br /> that would occur in this area due to unnecessary additional lake access; and <br /> (b) The property is unique in its small size and as a condominium <br /> development as opposed to a larger scale land division with many separate <br /> structures; and <br /> (c) The Developer would suffer unique hardship if required to provide <br /> water access due to the size of the property, its location regarding Town road <br /> mw1P4800E 14$CON$DRBs,ToW <br /> 0304970940 5 <br />
