(Referring to page 3 item A of the Town operator agreement) <br /> Amend the wording of this section by deleting the words "Town shall <br /> at request of" and adding the work "shall" after the word operator. <br /> 8 . (Referring to page 4 of the Town operator agreement) The bond <br /> referred to shall be in favor of the Town and Dane County. <br /> 9. (Referring to page 4 of the Town operator agreement) The bond <br /> for the reclamation plan shall be jointly payable to the Town and <br /> Dane County. <br /> 10. To find that Standard 1 is met. <br /> 11 . To find that Standard 2 is met. <br /> 12 . To find that Standard 3 is met because most uses in the A-1 <br /> Exclusive district are limited and include other quarries and not <br /> residential development areas. <br /> 13. To find that Standard 4 is met. <br /> 14 . To find that Standard 5 is met. <br /> 15. To find that Standard 6 is met. <br /> 16. To find that the Standards of the Zoning Ordinance are met and <br /> to approved the Conditional Use Permit #1265 as conditioned (items <br /> 1, 2, 3, 4, 5, 6, 7, 8, 9. <br /> THE ZONING AND NATURAL RESOURCES COMMITTEE AFTER PUBLIC HEARING AND <br /> IN THEIR CONSIDERATION OF THE CONDITIONAL USE PERMIT MADE THE <br /> FOLLOWING FINDING OF FACT: <br /> 1 . That the establishment, maintenance and operation of the <br /> proposed conditional use will not be detrimental to or endanger <br /> the public health, safety, morals, comfort or general welfare. <br /> 2 . That the uses, values and enjoyment of other property in the <br /> neighborhood for purposes already permitted will not be <br /> substantially impaired or diminished by the establishment, <br /> maintenance and operation of the proposed conditional use. <br /> 3. That the establishment of the proposed conditional use will not <br /> impede the normal and orderly development and improvement of <br /> the surrounding property for uses permitted in the district. <br /> 4 . That adequate utilities, access roads, drainage and other <br /> necessary site improvements will be made. <br /> 5. That adequate measures will be taken to provide ingress and <br /> egress so designed as to minimize traffic congestion in the <br /> public streets. <br /> 6. That the proposed conditional use does conform to all <br /> applicable regulations of the district in which it is proposed <br /> to be located. <br /> 7. This use will benefit the needs of either the residents or the <br /> agricultural activities in the area. <br /> 8 . There are not other locations available for this use. <br /> 9. The land to be occupied by this use is not productive <br /> agricultural land. <br /> 10. Public services needed by this use are available. <br /> 11 . Public services needed by this use can be furnished without <br /> becoming an unreasonable burden on the taxpayers . <br /> 12 . This use at this location will not cause significant harm to <br /> the environment. <br />
