(iv) In the event of any good faith dispute, Operator shall take <br /> reasonable steps to mitigate any inconvenience to the property owner pending a <br /> decision by the University of Wisconsin-Madison Department of Geological <br /> Sciences or other qualified neutral consultant. <br /> (v) The non-prevailing party to the dispute shall have the <br /> responsibility for payment of all reasonable costs and reasonable attorney's fees <br /> of the prevailing party and the costs of the University of Wisconsin-Madison <br /> Department of Geological Sciences or other qualified neutral consultant <br /> incurred in rendering its decision. <br /> (vi) Operator shall post and maintain at all times during the term of <br /> this Agreement and the CUP, a bond in favor of the Town in the amount of <br /> Fifteen Thousand Dollars ($15,000.00) as security for its obligations under this <br /> subsection. <br /> D. Noise. Operator will immediately create and maintain in accordance <br /> with its plans fifteen (15) foot landscaped earthen berm around the opened area of the <br /> quarry for the purpose of mitigating the noise, visual and safety concerns of the <br /> neighbors. The berm shall be seeded. At all times during the term of this Agreement, <br /> Operator shall require all trucks entering and leaving the quarry to have proper muffler <br /> systems and controls which meet or exceed the then most current industry standards <br /> for noise abatement and shall similarly require all crushing equipment to meet or <br /> exceed the then most current industry standards for noise abatement. <br /> E. Transportation. The only entrance to the quarry area shall be a haul road <br /> on Union Road as per submitted plans. Additional access points may be allowed by <br /> the Operator for agricultural uses on the Property. The haul road will be paved, and <br /> will be maintained in a dust-free manner in accordance with local, state, and federal <br /> regulations. No Town roads other than Union Road will be used by trucks entering or <br /> leaving the quarry except with the approval of the Town Board in unusual <br /> circumstances, which approval will not be unreasonably withheld or delayed. <br /> Operator shall be responsible for repairing damage to Union Road occurring as a result <br /> of its hauling and other quarry operations. <br /> Operator shall post and maintain at all times during the term of this Agreement <br /> and the CUP a bond in favor of the Town in the amount of twenty (20) thousand dollar <br /> as security for damage done to Union Road attributable to its use for hauling and other <br /> quarry operations. The affected town road is Union Road from Locust Road town <br /> road southerly to County Trunk "A". The Town may review the adequacy of the bond <br /> amount every five years.
