for road maintenance and construction, the bond amount appears inadequate to the <br /> Town, operator shall post and maintain such increased bond in favor of the Town <br /> within 30 days after the Town's request to the operator. <br /> F. Hours of Operation. Hours of operation for all operations except <br /> crushing and blasting shall be from 7:00 a.m. to 7:00 p.m., including maintenance <br /> time, Monday through Friday, and 7:00 a.m. to 4:00 p.m. on Saturday. Hours of <br /> crushing shall be limited to 10 hours per day on weekdays within the hours of 7:00 <br /> a.m. to 7:00 p.m. and 8 hours per day on Saturdays within the hours of 7:00 a.m. to <br /> 4:00 p.m. No operations shall be conducted on Sundays or legal holidays. These <br /> hours may be expanded with the approval of the Town Board if the quarry operations <br /> are being performed for public contracts. <br /> G. Stormwater Control. Stormwater in the opened area of the quarry shall <br /> be controlled by use of one or more of the following methods: grading, contouring, <br /> berming, landscaping and the use of detention ponds. Stormwater within the quarry <br /> area shall be directed to detention areas. <br /> H. Dust Control. Operator will maximize dust control in accordance with <br /> local, State and federal regulations. Operator will also provide and install an air <br /> monitor at its own expense which will be placed at a location and for a duration of <br /> time suggested by the DNR. Operator shall require it's own trucks and it's leased <br /> trucks to be tarped after loading prior to leaving the quarry. <br /> 5. Reclamation Plan. The quarry shall be reclaimed to farming and agricultural <br /> uses. The quarry will be developed in sequenced phases according to the Land Use Plan filed <br /> with Dane County as part of Operator's CUP application, and each area developed shall be <br /> reclaimed as soon as reasonably practicable as new areas of each phase are developed. <br /> Reclaimed areas shall be covered with overburden and topsoil and shall be seeded as soon as <br /> practicable after placement of the topsoil. The quarry operations plan showing the <br /> reclamation pattern is attached to this Agreement as Exhibit B. Topsoil and overburden on <br /> the Property shall remain on site. Final reclamation of the last opened area shall be finished <br /> within two (2)years after all mineral extraction operations have ceased. Operator shall post <br /> and maintain at all times during the term of this Agreement and the CUP, and for a period of <br /> two (2)years after all mineral extraction operations have ceased or upon completion of <br /> reclamation if within such two (2)year period, whichever is later, a bond in favor of the Town <br /> in the amount of Seventy-five Thousand Dollars $75,000.00 payable to the Town of Oregon, <br /> to insure compliance with the reclamation plan. The Town may review the adequacy of the <br /> bond amount every five years. If, as a result of increases in the cost of labor and/or materials <br /> for general construction, the bond amount appears inadequate to the Town, operator shall post <br /> and maintain such increased bond in favor of the Town within 30 days after the Town's <br /> request to the operator. <br /> 5 <br />
