Enclosed is <br /> the fee for the combined petition in the amount of$150.00. <br /> The two parcels of land involved in this petition are located in the Town of Dunkirk. <br /> The two parcels contain approximately 7.03 acres including the highway right of way <br /> for CTH Highway A (or 6.75 acres excluding the highway right of way). One of <br /> these parcels (Lot 1 of Certified Survey Map 3280) is currently in use as a cemetery. <br /> Enclosed are copies of the certified survey map of Lot 1 of C.S.M. 3280, ("Lot 1") <br /> and a map and legal description of the proposed cemetery addition (Parcel A on the <br /> map, referred to here as "Parcel A"). The tax parcel number for Lot 1 is 13-0511- <br /> 091-9270-4. The tax parcel number for Parcel A is 13-0511-091-9280-2. <br /> On behalf of the Lutheran Cemetery Association, we petition to have Lot 1 and Parcel <br /> A rezoned to zoning classification A-2(4). <br /> Lot 1, the existing Lutheran Cemetery, is currently zoned "A-1 Exclusive." Using <br /> Lot 1 as a cemetery is a nonconforming use that is being "grandfathered" since it <br /> was in use as a cemetery when the zoning laws were adopted. Parcel A is currently <br /> zoned A-2. The proposed rezoning will allow the Lutheran Cemetery Association, <br /> should the county board approve, to obtain a conditional use permit for the existing <br /> cemetery and the future cemetery expansion on Parcel A. A conditional use permit is <br /> not currently possible on Lot 1 since a cemetery is not an allowed conditional use <br />
