9. The Town of Christiana shall negotiate with the
owner/operator the number of holes shot.
Number 9 is objected to. The applicant has agreed to notify
the Wisconsin Power & Light and the Village of Rockdale when
blasting is proposed. When blasting is to be done, it is necessary
to shoot at least sixty (60) holes per shot.
10. The owner/applicant shall notify, in writing, the Town of
Christiana Clerk, Wisconsin Power and Light, and the
residents living within one quarter (1/4) mile of the pit
the dates of blasting at the quarry. Said written
notification shall be provided more than 72 hours prior
to the blasting.
The applicant agrees to notify Wisconsin Power and Light and
the residents living within one quarter ( 1/4 ) mile of the pit in
accordance with the recommendation. There is no reason to notify
the Town of Christiana Clerk as no other residents of the Town
could possibly be affected.
11. Special impact considerations to be applied to the
locations number one (1) (yellow-middle page- #1, Exhibit
A) and two (2) (yellow-middle right #2, Exhibit A) . Both
of these parcels and residential locations will be
offered the following by applicant:
A. Due to the potential impact on the property values,
if the parcel owners so desire, at the time of
transfer, the owner/applicant shall buy at the
price established in subparagraph B. or pay the
difference between the actual sale price and the
price derived from the 1995 equalized value,
corrected to the year of sale, to the parcel
owners.
B. The fair market value shall be established using
the 1995 assessment and then apply the equalization
factor to establish the current fair market value.
12. There shall be a minimum of a 500 foot set back which
shall include a living fence from the Anderson
residential property lines.
