The first paragraph of Town Board Recommendation Number 8 <br /> represents one method of solving the transportation problem <br /> suggested by Mr. Lien as part of his conditional use proposal. <br /> Under this proposal, Mr. Lien would put in a private road across <br /> Section 23 to County Trunk Highway B. In view of the fact this is <br /> a private road across Mr. Lien's property, we believe there is <br /> little reason to have the road be dust free since the only property <br /> affected by the dust would be Mr. Lien's property. In addition, if <br /> the road is private, the location of the road should be up to the <br /> applicant. <br /> The applicant's second proposal was to supply sufficient <br /> aggregate to provide a Class A base and lift to 1.6 miles of <br /> Christian Town Road. This road upgrading would be from 360 <br /> Koshkonong West to Clearview Drive and South to County Trunk <br /> Highway B. The applicant also offered sufficient aggregate to <br /> compensate for one inch of hot mix over the same road area. <br /> The Town's proposal to have applicant rebuild 1.6 miles of <br /> Town Road is unacceptable because it is cost prohibitive to <br /> applicant and applicant's use of the roadway is neither exclusive <br /> nor does it diminish the useful life of the road once it is <br /> elevated to Class A Status. <br /> In addition, there is no legal authority for nor reason to <br /> restrict the use of town roads by applicant by requiring the <br /> written permission of the Town Board once the materials have been <br /> trucked on the private road to County Trunk Highway B. <br /> 5 <br />
