The applicant accepts the concept of pine tree cover, but does <br /> not believe that such pine tree plantings should extend outside the <br /> 80 foot set back along roadway right-of-ways. In addition, there <br /> is no reason to plant trees at a 3 foot height. The applicant will <br /> agree to plant seedlings in the set back area which should grow to <br /> height expected by the time operations begin. Finally, the <br /> applicant objects to the use of alfalfa since it is hard to <br /> maintain alfalfa as ground cover. <br /> The pine tree cover should deal with the Town Board's <br /> concerns. An additional berm is unnecessary and duplicitous. <br /> 14. The hours of operation shall be limited to 6:00 a.m. to <br /> 7 :00 p.m. Monday through Friday and 7:00 a.m. through <br /> Noon on Saturday. There shall be no Sunday operations. <br /> Crushing of stone shall be limited to 6:00 a.m. to 6:00 <br /> p.m. , Monday through Friday. Crushing shall not be <br /> permitted on Saturday, Sunday, or legal holidays. <br /> During operation and crushing, owner/applicant shall take <br /> all reasonable efforts to reduce and minimize dust and <br /> shall take all reasonable efforts to minimize the noise <br /> of the operation. <br /> Limitation of hours of operation by Condition 14 is way too <br /> severe and not necessary. The applicant needs to have open hours <br /> on crushing and hauling Monday through Saturday. Additionally, the <br /> applicant needs flexibility as to the applicability of the hours of <br /> operation limitation in the months of May through September. <br /> 15. Site shall be used for agricultural lime and gravel <br /> removal only. No redi-mix, concrete or asphalt <br /> production or manufacturing processes are allowed. <br /> This condition is unnecessary because applicant does not <br /> intend to produce hot mix asphalt.
