. i <br /> Page Five: <br /> 21. All access and haulage roads shall be maintained by <br /> surfacing or treatment to ,keep dust to a minimum. <br /> 22 . At the Koshkonong Road crossing, owner/applicant shall pave <br /> an entrance area 100 feet on both sides of the road to protect <br /> the road edges. <br /> 23 . After depletion of the sites described as Areas II (1st <br /> phase) and Area IV (3rd phase) , owner/applicant can apply for <br /> CUP in Area I (4th phase) and Area III (2nd phase) . The <br /> Township provides no assurances that the CUP will be approved. <br /> 24 . Owner/applicant shall maintain liability insurance coverage <br /> in the amount of $5, 000, 000. 00 and maintained at that level or <br /> greater until the quarry is closed or CUP expires. Proof of <br /> insurance shall be submitted annually to the Town Board and the <br /> Town of Christiana shall be named as an additional insured. <br /> 25. A letter of credit in the amount of $50, 000. 00 shall be <br /> provided to the Township of Christiana to assure completion of <br /> the reclamation as specified in paragraph 20. Said letter of <br /> credit shall remain in effect until the reclamation has been <br /> completed and approved by Dane County. <br /> 26 . Owner/operator shall possess all necessary permits to <br /> operate a quarry. <br /> 27 . The owner/applicant shall indemnify and hold harmless the <br /> Town of Christiana, their board members and representatives from <br /> any and all liability, damages, expenses and attorney fees that <br /> the Township, their board members and representatives suffer as <br /> a result of any action or claim against the Township, their <br /> board members and representatives as a result of the quarry <br /> operation or use of the mineral extraction site. <br /> Respectfully submitted, <br /> David W.
